Lessee Responsibilities. Lessee agrees to absolve Lessor from personal responsibility in the event the occupant of the premises at the commencement of the term of this lease fails or refuses to surrender to vacate to Lessee until Lessor has been given a reasonable time to lawfully regain possession of said premises. The parties agree that this lease is binding upon Lessor, Lessee, their heirs, devisees, legatees, executors, administrators, legal representatives, successors or assigns of the Lessor and Lessee respectively. The failure of the Lessor to insist upon strict performance of any of the covenants or conditions of this lease or to exercise any option herein conferred in any one or more instances shall not be construed as a waiver or relinquishment of any such covenants, conditions or options but the same shall be and remain in full force and effect. The Lessee agrees that all personal property placed in the leased premises or in any other portion of the Lessor’s property or any place appurtenant thereto shall be at the sole risk of the tenant or the owners thereof and the Lessor shall in no event be liable for the loss, destruction, theft of or damage to such property. Residents are encouraged to secure and appropriate insurance to cover such losses. The Lessor concedes the Lessee’s right to have parties, or a number of guests, but in doing so, shall insist that perfect order prevail, and that boisterous conduct be avoided. A violation of this regulation will, at the option of the Lessor, void this lease. The Lessor reserves the right to make and enforce such other reasonable rules and regulations as in its judgment may be deemed necessary from time to time to promote the safety, care and cleanliness of the premises and for the preservation of good order herein and Lessee does agree to obey all rules and regulations promulgated by Lessor and agrees that a violation of said rules and regulations will, at the option of Lessor, void this lease. Lessee agrees to repair all underground pipes from the meter to the home and to relieve stoppage of the same. If due to natural causes or deterioration, Lessor will be responsible for repairs, however, the Lessor shall not be responsible for the same if such is caused by carelessness, neglect or improper use by Lessee. Xxxxxx agrees to timely report to Lessor any non-compliant meal or rest periods and any overtime worked by nonexempt Shared Personnel while working on behalf of Xxxxxx.

To place trash in the appropriate receptacles. F. To keep noise levels to a minimum and avoid disturbing the neighbors. G. To notify the Lessor of any needed repairs. H. To notify the Lessor immediately upon discovering any roaches, fleas, bed bugs, etc. If Lessor is not notified immediately, the treatment of the lessee’s unit and/or additional areas may become the responsibility of the lessee. I. To pay full rent pending settlement of claims you may have. J. To inform Lessor of all maintenance work to be done to the rented unit and common areas, including installing air conditioning units, rather than attempting to complete the work on their own.

(b) Access to the pad shall be unrestricted to PDI personnel regardless of the time of day or night and work or maintenance of the unit may take place regardless of any operations taking place by the LESSEE and persons in PDI's employ shall be unrestricted to enter upon the pad for any purpose, however, any entry or attempt to enter the PDI Power Solution’s Equipment container by the LESSEE its agents, servants or employees (except in the event of emergency or public safety) shall immediately void all warranties express or implied from PDI. PDI may access the Equipment at any time without either notice or permission from LESSEE. PDI shall provide LESSEE with reasonable notice of such access (which does not need to be in writing) during normal business hours after such access. (c) Measuring devices (including electric usage meters) are part of the PDI Power Solution Equipment. The measuring devices shall be presumed to be accurate and shall be the sole measure of electricity used by LESSEE. (d) The LESSEE will keep the Equipment completely accessible and unencumbered at the Equipment Location (specified in the applicable Schedule). (e) The LESSEE's obligations and PDI's rights and privileges as contained in this paragraph shall survive the expiration or other termination of this Agreement.

Lessee Responsibilities. Without limiting any other obligations under any other paragraph of this Lease, Lessee shall be solely and completely responsible for responding and complying with any administrative notice, order, request, or demand or any third party claim or demand relating to potential or actual environmental contamination by hazardous substances caused by Lessee or its successors, assigns, sublessees, contractors, or invitees on or under the Premises, including, but not limited to, response, clean up and removal. Responsibility conferred under this paragraph includes, but is not limited to, responding to such orders on behalf of Lessor in defending against any assertion of Lessor's financial responsibility or individual duty to perform under such orders.
Lessee Responsibilities. A. Lessee shall exercise normal and reasonable care of the equipment while it is in his/her possession. B. Lessee must recognize the hazards associated with the operation of the equipment and must follow the personal safety requirements necessary to ensure the safe use and operation of the rented equipment, including but not limited to observing the safety information provided on Page 3 of this Agreement and following all manufacturer safety requirements and warnings as contained in the Operator Manual included with the equipment. C. Lessee shall, at all times while equipment is in his or her possession and at Lessee's own cost and expense, maintain insurance against all risks of physical loss or damage to equipment and for personal and bodily injury and property damage per occurrence. D. Lessee shall not request delivery of equipment until such time he or she is able to use it immediately. Once equipment arrives, the Lessee shall complete planting in as timely a manner as possible, as other customers may be waiting to use it. E. Equipment use shall be limited to the location and number of acres identified on Page 4 of this Agreement. Moving equipment by the Lessee to other location(s) and/or use of the equipment on additional acreage is prohibited unless otherwise approved in advance by the District. Resetting or tampering with acre meters is prohibited. F. Lessee shall notify the District immediately upon discovering any missing parts and/or damage that may have occurred while the equipment was in his or her possession. The District shall be notified in person or by calling 000-000-0000 x0. G. Lessee shall not replace parts and/or repair any damage unless otherwise agreed to in advance by the District. H. Lessee shall be responsible for any and all physical loss or damage to the leased equipment, including the cost to repair or replace such property. Replacement cost of each piece of equipment is shown as the Stipulated Loss Value (SLV) on Page 4 of this Agreement. I. The Lessee shall return leased equipment in as clean a condition as it was delivered, and shall remove all leftover seed and debris from seed boxes, cups and tubing. Leftover seed and debris shall be removed by vacuuming or blowing; water and other liquids shall NOT be used. Lessee Responsibilities. A. Lessee is responsible for all routine and deep cleaning of the interior space, including but not limited to all surfaces, flooring, restrooms, windows, offices, appliances and night shelter/detox tools, equipment and operations etc. B. Recycling and composting is required of the Lessee during the term of the lease. C. In order to ensure the safety of the building tenants, building infrastructure and to meet other state and county regulations the Lessee is required to contact the Pitkin County Facilities Director/Operations Manager for pre-approval of all equipment upgrades, replacements, and additions in their lease space, including but not limited to heating/cooling devices, large kitchen appliances such as dishwasher, garbage disposals, refrigerators, laundry, and network equipment such as server locations. Pre-approvals must be submitted in writing 30 days prior to installation. Failure to receive written approval will be a considered non-compliance with the lease agreement.
