Common use of Lesser Duty Rule Clause in Contracts

Lesser Duty Rule. Notwithstanding their rights under the Anti-dumping Agreement and the Subsidies Agreement as regards the application of anti-dumping and countervailing duties, the EU Party and Colombia consider it desirable that the duty applied be less than the corresponding margin of dumping or subsidy, as appropriate, if the lesser duty would be adequate to remove the injury to the domestic industry.

Lesser Duty Rule. Notwithstanding their rights under the Anti-dumping Agreement and the Subsidies Agreement as regards the application of Should EU or Colombia decide to impose anti-dumping and or countervailing dutiesduty, the EU Party and Colombia consider amount of such duty shall not exceed the margin of dumping or countervailing subsidies, but it is desirable that the duty applied be less than the corresponding margin of dumping or subsidy, as appropriate, if the such lesser duty would be adequate to remove the injury to the domestic industry.
