Common use of Lessor's Right to Perform for Lessee Clause in Contracts

Lessor's Right to Perform for Lessee. If Lessee fails to duly and promptly perform any of its obligations under this Lease or fails to comply with any of the covenants or agreements contained herein, Lessor may itself perform such obligations or comply with such covenants or agreements, for the account of Lessee, without thereby waiving any default, and any amount paid or expense (including, without limitation, attorney's fees) reasonably incurred by Lessor in connection with such performance or compliance shall, together with interest thereon at the Default Interest Rate, be payable by Lessee to Lessor on demand.

If Lessee fails to duly and promptly make any payment or perform any of its obligations under this Lease or fails to comply with any of the its covenants or agreements contained hereinobligations hereunder, Lessor may itself may, but shall not be required to, make such payment or perform such obligations or comply with such covenants or agreements, for the account and obligations on behalf of Lessee, without thereby waiving and the amount of any default, such payment and any amount paid or expense the expenses (including, without limitation, attorney's including but not limited to reasonable attorneys' fees) reasonably incurred by Lessor in connection performing or complying with such performance or compliance shallcovenants and obligations, as the case may be, together with interest thereon at the Default Interest Ratehighest lawful rate, shall be payable by Lessee to Lessor on upon demand.

Lessor's Right to Perform for Lessee. If the Lessee fails to duly and promptly perform any of its obligations under this Lease or fails to comply with any of provision in this Lease, the covenants or agreements contained herein, Lessor may itself upon notice to the Lessee (but shall be under no obligation to) perform such obligations or comply with such covenants or agreements, for the account of Lessee, without thereby waiving any defaultprovision, and any the amount paid or expense (including, without limitation, attorney's fees) reasonably of the reasonable costs and expenses of the Lessor incurred by Lessor in connection with such performance or compliance shall, together with interest thereon at the Default Interest Rate, shall be payable by the Lessee to upon demand as a Supplemental Lease Payment. No such performance or compliance by the Lessor on demandshall be deemed a waiver of the rights and remedies of the Lessor against the Lessee under this Lease.
