Common use of LETTER OF CREDIT AND REIMBURSEMENT AGREEMENT Clause in Contracts

LETTER OF CREDIT AND REIMBURSEMENT AGREEMENT. As a further condition to the Issuer's financing the Project hereunder, the Company shall: (a) cause the Letter of Credit to be issued and delivered to the Credit Facility Trustee as security for the Bonds and until the Conversion Date, cause a Credit Facility meeting the requirements of Section 6.3 of the Indenture to be maintained with the Credit Facility Trustee; and (b) enter into the Reimbursement Agreement with the Bank in form and substance satisfactory to the Bank and execute and deliver the other Letter of Credit Documents required by the Bank.

As a further condition to the Issuer's financing making the Project loan hereunder, the Company shall: (a) cause the Letter of Credit to be issued and delivered to the Credit Facility Trustee as security for the Bonds and until Bonds. Until the Conversion Date, the Company shall cause a Credit Facility meeting the requirements of Section 6.3 603 of the Indenture to be maintained with the Credit Facility Trustee; and (b) enter into the Reimbursement Agreement with the Bank in form and substance satisfactory to the Bank and execute and deliver the other Letter of Credit Documents required by the Bank.
