Level III - Superintendent. 5.5.1 If the grievant is not satisfied with the decision at Level II, or if no written decision has been rendered within fifteen (15) work days after the presentation of the grievance at Level II, the grievant may appeal the decision, in writing, to the Superintendent within fifteen (15) work days.
5.5.2 This statement shall include a copy of the original grievance and appeal at each level, the decisions rendered at each level, and a clear, concise statement of the reasons for the appeal.
Level III - Superintendent. If the grievant is not satisfied with the decision at Level II, or if the immediate supervisor does not respond within the timelines as required by Level II, then within five (5) days after receipt of the Level II response or the expiration of the time within which the immediate supervisor must respond, the grievant may then appeal the decision, or lack thereof, on the appropriate form to the Superintendent. Upon receipt of an appeal from the grievant to the Superintendent, the Superintendent shall review the grievance and communicate a written decision within five (5) days of receipt of the grievance. Within the stated time limits, either party may request and be granted a personal conference concerning the grievance. If the Superintendent is also the immediate supervisor of the grievant, this level shall be by passed.
Level III - Superintendent. If a satisfactory solution is not achieved by discussion with the principal, a written request for a conference shall be submitted to the Superintendent by the complainant. This request should include:
1. The specific nature of the complaint and a brief statement of the facts giving rise to it;
2. The respect in which it is alleged that the complainant (or child of the complainant) has been affected adversely. Should the matter be resolved in conference with the Superintendent, the Board shall be advised of the resolution.
Level III - Superintendent. If the aggrieved is not satisfied with the suggestion for resolution received in Level II, he/she may within five (5) days of receipt of such written response, submit his/her written grievance to the Superintendent and request a meeting to discuss the grievance. A meeting date shall be mutually agreed upon between the aggrieved and the Superintendent within five (5) days of the written request. The meeting shall be conducted in a manner as stated in Level II. Within five (5) days of the meeting, the Superintendent shall provide the aggrieved with a written response stating his/her position and resolution of the grievance.
Level III - Superintendent. (1) If the grievant and the Association Committee are not satisfied with the written decision at the conclusion of Level II and wish to proceed further under this grievance procedure, within five (5) school days following the receipt of decision, the grievant and the Association Committee shall file the grievance and a copy of the written decision at Level II with the Office of the Superintendent.
(2) Within five (5) school days after receipt of the appeal, the Superintendent, or his duly authorized representative shall hold a meeting with the grievant and the Association Committee.
(3) The Superintendent shall render a decision in writing to the grievant and the Association Committee within five (5) school days after the conclusion of the meeting.
Level III - Superintendent. (a) If the grievant is not satisfied with the disposition at Level II, the grievant may appeal to the Superintendent by providing the signed grievance form to the Superintendent within ten (10) working days of receipt of the Level II response.
(b) A meeting between the Superintendent and the grievant shall be held on a mutually agreeable date and time within ten (10) working days of the filing of the grievance with the Superintendent. The Superintendent shall provide the grievant with a written response within ten (10) working days of the meeting.
Level III - Superintendent. 1. If the grievant is not satisfied with the results of Level II, he/she may, within seven (7) days of receipt of the Level II decision, continue the procedure by submitting the written grievance to the Superintendent/designee with a copy to the Association President.
2. Within fourteen (14) days of receipt of the form, the Superintendent/designee shall render a written decision. The decision reached at this meeting will be recorded in Level III of the Grievance Report Form (Appendix B) and a copy will be sent to the grievant and Association President.
Level III - Superintendent. 4.4.2.1 In the event the grievant is not satisfied with the decision at Level II, he/she may appeal the decision, in writing, to the Superintendent of the Riverbank Unified School District within twenty (20) days from receipt of the Level II decision.
4.4.2.2 This appeal should include a copy of the original grievance, the decision rendered, and a clear, concise statement of the reasons for the appeal.
4.4.2.3 The Superintendent of the School District shall communicate his/her decision within ten (10) days after receiving the appeal. Either the grievant or the Superintendent may request a personal conference within the above time limits.
4.4.2.4 If the Superintendent does not respond within the time limits, the grievant may appeal to the next level.
Level III - Superintendent. Within ten (10) days after receipt of the appeal, the Superintendent or designee shall render a decision in writing to the grievant. In the event the grievance is not resolved at Level III, the decision may be appealed to Level IV, provided such appeal is submitted on the prescribed form (Appendix D-3) to the Superintendent within ten (10) days after receipt of the decision at Level III. The parties may, by mutual agreement, within the ten (10) days for appeal to Level IV, agree in writing to submit the grievance to an informal hearing and non-binding recommended resolution of a mediator. If the grievance is not resolved in such a fashion, the grievant has ten (10) days from the date of the optional mediation meeting to file the grievance at Level IV.
Level III - Superintendent a. In the event the grievant is not satisfied with the decision at Level II, the decision may be appealed, in writing, to the Superintendent, or designee, within ten (10) days.
b. The Superintendent or designee (appropriate District Officer) shall communicate the decision, in writing, to the grievant within ten (10) days of receipt of the appeal.
