Levels of Procedure. Level One (Informal): Principal: The grievant will within ten (10) days of the occurrence giving rise to the grievance, or ten (10) days from when grievant should reasonably have had knowledge of same, present the grievance orally and informally to the Principal with the objective of resolving the grievance informally. The Principal will have ten (10) days in which to respond in writing to the grievance.
Levels of Procedure. 1. Level One (Building Level) - Step One: An Aggrieved Person with a Grievance shall, within forty-five (45) school days after either the occurrence of the event or acts which give rise to the Grievance or the date on which the Aggrieved Person knew of or would be reasonably expected to know of such, first orally discuss it with his or her Principal, or immediate supervisor, with the objective of resolving the matter informally. Failure to act within said forty-five (45) school day period shall be deemed to constitute an abandonment of the Grievance. The Aggrieved Person and the appropriate Principal, or immediate supervisor shall, at the conclusion of such oral discussion, execute a form acknowledging such discussion. The Principal, or immediate supervisor, shall communicate his decision to the Aggrieved Person within five (5) school days next following said oral discussion. If the Principal, or immediate supervisor, fails to communicate his decision within said five (5) school day period, the relief sought shall be deemed denied and the Aggrieved Person may proceed to Step Two of Level One of the Grievance Procedure. If the relief sought in Step One of Level One is denied, the Aggrieved Person may, within five (5) school days following the denial, file his Grievance in writing with the Principal setting forth the specific allegations of fact which gave rise to the Grievance, the specific provision(s) of the Agreement or Board Policy or the particular past practice alleged to have been violated, the date as of which the event or acts which gave rise to the Grievance first occurred, and the relief sought. If the appeal is not timely filed in writing with the Principal, the decision at Step one of Level One shall be final and the matter closed. If the appeal is timely filed with the Principal, then the Principal shall communicate his decision in writing to the Aggrieved Person within five (5) school days next following the filing of the written Grievance. If the Principal fails to communicate his decision in writing within the time prescribed, the relief sought shall be deemed denied and the Aggrieved Person may proceed to the next level of the Grievance Procedure.

If the relief sought in Step One of Level One is denied, the Teacher may, within three (3) school days following the denial file his/her Grievance in writing with the Principal setting forth the specific nature of the Grievance, the facts relating thereto and the action requested to be taken. The Principal shall communicate his/her decision in writing to the Teacher within three (3) school days next following the filing of the written Grievance. If the Principal fails to communicate his/ her decision in writing within the time prescribed, the relief sought shall be deemed denied and the Teacher may proceed to the next level of the Grievance Procedure.

2. Level Two - Executive Director (Formal): If the grievance is not resolved to the satisfaction of the grievant within ten days of initiating the informal process (Level 1), the grievant may file a written grievance with the Executive Director no later than fifteen (15) days after the ten day period has lapsed. The written grievance will contain the following: (See Appendix B)
a. A statement of the grievance and the facts upon which it is based;
b. The remedial action being requested;
c. The section of this Agreement which was allegedly violated. The parties shall meet within ten (10) days of filing the grievance. The Executive Director will have ten (10) days in which to respond in writing to the grievance unless a necessary investigation is ongoing and more time is required. The Executive Director will contact the grievant to communicate the anticipated date of the response.
3. Level Three - Charter Board: If the grievance is not resolved to the satisfaction of the grievant, the grievant may appeal the grievance to the Board no later than ten (10) days following receipt of the Executive Director’s response. The parties will agree on a date to conduct the hearing within ten (10) days. At the hearing, the grievant will present the grievance and the Executive Director will share reason(s) for the denial. The Board will respond to the parties in writing within ten (10) days.
4. Level Four - Arbitration: If the grievance is not resolved by the Board to the satisfaction of the grievant, the grievant and the Association may give written notice to the Executive Director of the intent to take the grievance to arbitration. Such notice will be given to the Executive Director within fifteen (15) days of receipt of the Board’s decision. Within five (5) days of receipt of the request for arbitration, the parties will meet and attempt to select an arbitrator and obtain a commitment from such arbitrator to serve. Levels of Procedure. The goal of the district is to have the employee and supervisor and/or Principal attempt to resolve any difference before a formal grievance is filed.
1. Level I - Initial Level Any employee grievant who has a grievance shall submit in writing to the designee of the Superintendent as follows:
a) Schedule/instruction matters shall be submitted to the Principal.

Level Two - Principal: If the grievance is not resolved to the satisfaction of the grievant after receipt of the response in Level One, the grievant may file a written grievance with the Principal no later than fifteen (15) days after receipt of the Level One response. The written grievance shall contain the following:
1. A statement of the grievance and the facts upon which it is based.
2. The remedial action being requested.
3. The section of this Agreement which was allegedly violated. The Principal shall have fifteen (15) days in which to respond in writing to the grievance. The Board will have fifteen (15) days in which to make a written response to the grievance after holding a hearing in either of the following two processes:
1. The Board may choose to hear the grievance with the grievant, his/her counsel and/or an Association Representative; or
2. The Board may elect to form a committee of less than a quorum of the Board to hear the grievance as before and make a recommendation for the Board's ultimate decision. Such hearing by the Board shall be in an executive session unless the grievant makes a timely written request to hold it in a public session.
