Common use of Liability Deposit Clause in Contracts

Liability Deposit. 14.1. In case of an accident with a third-party, the Customer will be responsible for Damages up to the amount of the deductible (Liability Deposit). The Liability is applicable regardless of who is at fault and will be charged at the time the accident is reported to Condor Campers, not at the end of the Rental Period. Where a Third Party is involved and recognised as responsible for the accident, the Vehicle Liability Deposit will be refunded only if Condor Campers are successful in recovering the cost of the Damages from the Third Party. Please note that Third Party claims can take many months to resolve. 14.2. In the case of Damage to the Vehicle or loss of the Vehicles windows, mirrors, exterior lights, Tyres, Roof Top Tent, Accessories, Contents and Camping Utensils as detailed in Table 1, Condor Campers reserve the right to deduct the damage fees as detailed in Table 1 from the Customers’ Liability Deposit. 14.3. In case of a theft of the Vehicle, the Customer will be responsible for costs up to 2.500.000 CLP. 14.4. In case of driving the Vehicle under the influence of alcohol or drugs, the Customer will be responsible for costs up to 2.500.000 CLP 14.5. A single Vehicle accident (SVA) includes, but is not limited to A collision to a fixed object, a Vehicle that has rolled, tipped or fallen over and this has caused damage to the Vehicle. The Customer will be charged 2.500.000 CLP in case of a single Vehicle accident. 14.6. The Customer is fully liable for all costs due to Damages and inappropriate uses of the Vehicle as identified in clauses 8, 9 and 14. If the costs exceed the Liability Deposit, Condor Campers reserve the right to obtain these additional costs from the customer; 14.7. Accident/fine whilst not respecting any traffic signs. 14.8. Accident/fine whilst driving over the speed limit 14.9. Accident by falling asleep at the wheel or fatigue 14.10. Accident/fine whilst driving under the influence of alcohol or drugs. 14.11. Theft whilst leaving the Vehicle with the ignition key inside while it is unoccupied. 14.12. Damage to the Vehicles under body, roof (rooftop tent Damages included), interior or tyres (xxxxxxxx and rims), windows, windscreen, Vehicle accessories if not occurred during a reported multiple Vehicle accident. 14.13. Damages to door locks, door handles or windows in case of Vehicle break-ins 14.14. Damage to the Vehicle by: a) Submersion in any type of water b) Contact with salt water c) Creek or river crossing
