Common use of Liability Not Limited Clause in Contracts

Liability Not Limited. The liability of Company to City or any Person for any of the matters which are the subject of the liability insurance policy or policies required by this Section 10.2 shall not be limited by said insurance policy or policies nor by the recovery of any amounts thereunder; provided, however, that City shall, in no case, be entitled to duplicative recoveries from different sources.

Liability Not Limited. The liability of the Company and any Affiliated Person (not including a limited partner or an individual shareholder) to the City or any Person for any of the matters which are the subject of the liability insurance policy or policies required by this Section 10.2 shall not be limited by said insurance policy or policies nor by the recovery of any amounts thereunder; provided, however, that the City shall, shall in no case, case be entitled to duplicative recoveries from different sources.

Liability Not Limited. The liability legal Liability of the Company and any Affiliated Person to the City or and any Person for any of the matters which are the subject of the liability insurance policy or policies required by this Section 10.2 13.2, including, without limitation, the Company's indemnification obligation set forth in Section 13.1.06 hereof, shall not be limited by said such insurance policy or policies nor by the recovery of any amounts thereunder; provided, however, that City shall, in no case, be entitled except to the extent necessary to avoid duplicative recoveries recovery from different sourcesor payment by the Company or its Guarantor.
