Common use of LICENCE TO OCCUPY Clause in Contracts

LICENCE TO OCCUPY. 3.1. Subject to paragraph 4 and paragraph 9, the Property Owner permits the Guest and the members of the Guest’s party as listed on the Pre-Check-In Form or equivalent provided by the Guest to occupy the Property for the Licence Period in common with UnderTheDoormat (and all others authorised by UnderTheDoormat (so far as is not inconsistent with the rights given to the Guest to use the Property)) together with the right for the Guest to use: (a) such parts of the Common Parts as is necessary for the purpose of access to and egress from the Property; (b) the Furnishings; (c) the Service Media serving the Property. 3.2. The Guest acknowledges that: (a) the Guest shall occupy the Property as a licensee and that no relationship of landlord and tenant is created between the Property Owner and the Guest by this Licence; (b) UnderTheDoormat shall undertake the sole management of the Property during the Licence Period, including (but not limited to) the cleaning of the Property; (c) the Property Owner retains control and possession of the Property, and the Guest has no right to exclude the Property Owner or UnderTheDoormat (and any persons authorised by UnderTheDoormat) from the Property; (d) the licence to occupy granted by this Licence is personal to the Guest and is not assignable. The rights given in paragraph 3 may only be exercised by the Guest; (e) the Property Owner and UnderTheDoormat shall retain keys to the Property during the Licence Period, and the Property Owner and UnderTheDoormat (and any persons authorised by UnderTheDoormat) reserve their right (acting reasonably) to use these keys and enter the Property at any time during the Licence Period; and (f) the Guest must provide electronic copies of passport details or such other form of identification as UnderTheDoormat reasonably requires for all members of the Guest’s party prior to check-in and must provide the same original identity documents for inspection on check-in if required to do so. (g) the Guest is responsible for the actions of all members of the Guest’s party during the Licence Period. (h) The Guest must provide the credit, debit or other payment card used to pay for the Booking at check-in. If the Booking was made on a card belonging to another person, the Guest must ensure that the cardholder who paid for the Booking provides signed written confirmation of their agreement to pay for the Booking to UnderTheDoormat prior to check-in. UnderTheDoormat reserves the right not to proceed with the Booking if this confirmation from the cardholder is not provided and no refund will be granted in these circumstances.

RCC grants to NLPC the right for the Guest to use: (a) : such parts of the Common Parts as is necessary for the purpose of access to and egress from the Property; (b) the Furnishings; (c) Community Centre as shall from time to time be designated by RCC for such purpose; and the Service Media serving the Property. 3.2Community Centre. The Guest NLPC acknowledges that: (a) the Guest : NLPC shall occupy the Property Community Centre as a licensee and that no relationship of landlord and tenant is created between the Property Owner RCC and the Guest NLPC by this Licence; (b) UnderTheDoormat shall undertake the sole Agreement; RCC retains control, possession and management of the Property during the Licence Period, including (but not limited to) the cleaning of the Property; (c) the Property Owner retains control Community Centre and possession of the Property, and the Guest NLPC has no right to exclude the Property Owner or UnderTheDoormat (and any persons authorised by UnderTheDoormat) RCC from the Property; (d) Community Centre; the licence to occupy granted by this Licence Agreement is personal to the Guest NLPC and is not assignable. The assignable and the rights given in paragraph 3 this Agreement may only be exercised by NLPC and the Guest; NLPC Personnel. NLPC has the right to control the use of the Community Centre, or any part of it (ewhere a “part” may be the meeting room, kitchen, toilets, or entrance area) the Property Owner and UnderTheDoormat shall retain keys subject to the Property during terms of this Agreement. Accordingly, NLPC: shall control the Licence Periodhiring of all or part of the Community Centre to third parties in accordance with the Permitted Use, and shall appoint a bookings administrator for this purpose; shall set and receive the Property Owner relevant hire fees for such hiring; and UnderTheDoormat may, within its scale of hire charges, give preferential treatment to particular users or user groups (to the extent that this is permitted by Applicable Laws). NLPC shall pay to NLPS all costs associated with its share of the testing and maintenance of the Service Media, including but not limited to period testing and maintenance of the: firefighting equipment; fire alarm system including a fire risk assessment; water system including a legionella Risk Assessment; emergency lighting system; burglar alarm system; and gas and boiler system. NLPS is a potential user of the Community Centre so if NLPS, or any other person with a right to use NLPS premises or facilities, wishes to use the Community Centre then that use will be booked through NLPC, and NLPC has the right to charge for that use. NLPS has the right to control the use of NLPS facilities and any persons authorised by UnderTheDoormat) reserve their right (acting reasonably) other rooms or facilities within the school. NLPC: controls bookings of all or part of the NLPS premises; and sets and receives the hire fees for such hiring. NLPC shall liaise with NLPS in respect of third parties who wish to use these keys NLPS facilities and enter the Property at any time during the Licence Period; and (f) the Guest must provide electronic copies of passport details or such other form of identification as UnderTheDoormat reasonably requires for all members of the Guest’s party prior to check-in Community Centre. In doing so: NLPC and must provide the same original identity documents for inspection on check-in if required to do so. (g) the Guest is responsible for the actions of all members of the Guest’s party during the Licence Period. (h) The Guest must provide the credit, debit or other NLPS shall operate a shared booking & payment card used to pay for the Booking at check-in. If the Booking was made on a card belonging to another person, the Guest must ensure that the cardholder who paid for the Booking provides signed written confirmation of their agreement to pay for the Booking to UnderTheDoormat prior to check-in.
