Common use of Limit of Compensation Clause in Contracts

Limit of Compensation. 6.3.1 The maximum amount of compensation payable by either Party to the other in respect of liability under Clause 6.1 is limited to the amount stated in the Particular Conditions. 6.3.2 Each Party agrees to waive all claims against the other insofar as the aggregate of compensation which might otherwise by payable exceeds the maximum amount payable. 6.3.3 If a Party makes a claim for compensation against the other Party and this is not established the claimant shall fully reimburse the other for his costs incurred as a result of the claim.
