Common use of Limitation in Termination Compensation Clause in Contracts

Limitation in Termination Compensation. Irrespective of the reason for termination or the party terminating, the total sum paid to the Construction Manager may not exceed the construction price, as properly adjusted, reduced by the amount of payments previously made and penalties or deductions incurred pursuant to any other provision of this Agreement, and will in no event include duplication of payment.
