Common use of Limitation of Payments Clause in Contracts

Limitation of Payments. The District’s obligation to pay the Consultant for Services rendered pursuant to this Contract are conditioned upon the availability of government funds which are allocated to pay the Consultant. If funds are not allocated and available for the Owner to pay the Consultant for these services, the Owner may terminate this Contract at the end of the period for which the funds are available.
