Common use of Limitation of rights of action Clause in Contracts

Limitation of rights of action. (a) No VPS Noteholder is entitled to take any action against the Issuer or any other party in relation to any of the liabilities of the Issuer or any other party under or in connection with the VPS Conditions or this Agreement, other than through the VPS Trustee and in accordance with the VPS Conditions and this Agreement, provided, however, that the VPS Noteholders shall not be restricted from exercising any of their individual rights derived from the VPS Conditions or this Agreement.
