Common use of Limitation on City's Liability Clause in Contracts

Limitation on City's Liability. City shall not be responsible for or liable to Licensee, and Licensee hereby waives all Claims against City and its Agents and releases City and its Agents from, all Claims for any injury, loss or damage to any person or property (including the Equipment) in or about the Premises by or from any cause whatsoever (other than to the extent caused by the active negligence or willful misconduct of City and its Agents), including, without limitation, acts or omissions of persons using the sidewalk or street adjoining or adjacent to or connected with the Premises; theft; burst, stopped or leaking water, gas, sewer or steam pipes; or gas, fire, oil or electricity in, flood, or vehicle collision, on or about the Premises.
