Limitation of City’s Liability. The City will be liable, if at all, only for the cost of repair to damaged portions of the Facilities arising from the negligence or willful misconduct of City, its employees, agents, or contractors. The City, its agents, officers, employees, or contractors, shall not be liable for any damage from any cause whatsoever to the Facilities, specifically including, without limitation, damage, if any, resulting from the City’s maintenance operations adjacent to the Facilities or from vandalism or unauthorized use of the Facilities, except to the extent such damage is caused by the negligence or willful misconduct of City, its agents, officers, employees or contractors. The City will in no event be liable for indirect or consequential damages.

Limitation of City’s Liability. The CITY desires to enter into this Agreement only if in so doing the CITY can place a limit on the CITY’s liability for any cause of action arising out of this Agreement, so that the CITY’s liability for any breach never exceeds the sum of $1,000.00. For other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the CONSULTANT expresses its willingness to enter into this Agreement with the knowledge that the CONSULTANT’s recovery from the CITY to any action or claim arising from the Agreement is limited to a maximum amount of $1,000.00 less the amount of all funds actually paid by the CITY to the CONSULTANT pursuant to this Agreement. Accordingly, and notwithstanding any other term or condition of this Agreement that may suggest otherwise, the CONSULTANT agrees that the CITY shall not be liable to the CONSULTANT for damages in an amount in excess of $1,000.00, which amount shall be reduced by the amount actually paid by the CITY to the CONSULTANT pursuant to this Agreement, for any action or claim arising out of this Agreement. Nothing contained in this paragraph or elsewhere in this Agreement is in any manner intended either to be a waiver of the limitation placed upon the CITY’s liability as set forth in Section 768.28, Florida Statutes, or to extend the CITY’s liability beyond the limits established in said Section 768.28; and no claim or award against the CITY shall include attorney’s fees, investigative costs, extended damages, expert fees, suit costs or pre-judgment interest. Notwithstanding the foregoing, the parties agree and understand that the provisions of this Article 12.10 do not apply to monies owed, if any, for services rendered to CONSULTANT by the CITY under the provisions of this Agreement.
Limitation of City’s Liability. Tenant, its subtenants and Subcontractors must make no claims against the City for damages, charges, additional costs or fees or any lost profits or costs incurred by reason of delays or hindrances by the City in the performance of its obligations under this Agreement. All Tenant, subtenant, and Subcontractor personal property upon the Leased Space or upon any other part of the Airport, is at the risk of Tenant, subtenant, or Subcontractor respectively only, and the City is not liable for any loss or damage to it or theft of it or from it. The City is not liable or responsible to Tenant, its subtenants or Subcontractors, and Tenant waives, and will cause its subtenants and Subcontractors likewise to waive, to the fullest extent permitted by law, all claims against the City for any loss or damage or inconvenience to any property or person or any lost profits any or all of which may have been occasioned by or arisen out of any event or circumstance, including theft, fire, act of God, public enemy, injunction, riot, strike, insurrection, war, court order, requisition or order of governmental body or authority, or water leakage, steam, excessive heat or cold, falling plaster, or broken glass; or any act or neglect of the City or any occupants of the Airport, including the Terminals or the Leased Space, or repair or alteration of any part of the Airport, or failure to make any such repairs or any other thing or circumstance, whether of a like nature or a wholly different nature. If the City fails to perform any covenant or condition of this Agreement that the City is required to perform and, notwithstanding the foregoing, Tenant recovers a money judgment against the City, the judgment must be satisfied only out of credit against the Rent and other monies payable by Tenant to the City under this Agreement, and the City is not liable for any deficiency except to the extent provided in this Agreement and to the extent that there are legally available Airport funds.
Limitation of City’s Liability. (a) Except to the extent set forth in Section 9.2 or obligations, costs, expenses or liabilities arising out of the negligence or willful misconduct of City, no agreements or provisions contained herein nor any agreement, covenant or undertaking by the City contained in any document executed by the City in connection with any property of the Company will give rise to any pecuniary liability of the City, its officers and members of its governing body, or constitute a charge against the City’s general credit, or will obligate the City financially in any way, except with respect to the funds or property available under the Lease. Except to the extent set forth in Section 9.2 or obligations, costs, expenses or liabilities arising out of the negligence or willful misconduct of City, no failure of the City to comply with any terms, covenants or agreements herein or in any document executed by the City in connection with the Project will subject the City to any pecuniary charge or liability except to the extent that the same can be paid or recovered from the funds available hereunder. None of the provisions of this Lease will require the City to expend or risk its own funds or to otherwise incur financial liability in the performance of any of its duties or in the exercise of any of its rights or powers hereunder unless it will first have been adequately indemnified to its satisfaction against the cost, expense or liability which might be incurred thereby. Nothing herein will preclude a proper party in interest from seeking and obtaining, to the extent permitted by law, specific performance against the City for any failure to comply with any term, conditions, covenant or agreement herein; provided that no costs, expenses or other monetary relief will be recoverable from the City except as may be payable from the funds available hereunder.

City shall not be responsible for or liable to Operator and Operator’s agents and Operator hereby waives all Claims against City and its Agents and releases City and City’s Agents from all Claims for any injury, loss or damages to any person or property (including the Equipment) in or about the Premises by or from any cause whatsoever (other than to the extent caused to third parties from personal injury or property damages that occurs in the Premises caused by the intentional misuse or neglect, by City or City’s employees, agents and invitees), including without limitation, acts or omissions of persons using the sidewalks or right of way, streets adjoining or adjacent to or connected with the Premises; theft; burst, stopped or leaking water, gas, sewer, or steam pipes; or gas, fire, oil or electricity in, flood, or vehicle collision, on or about the Premises. Notwithstanding the forgoing, the City’s liability under this License shall in all cases be subject to, and shall not exceed the statutory dollar limits provided in NMSA (1978) Section 41-4-1 et. seq., as it may apply to the City at the time of any occurrence or Claim. The provisions of this subsection shall survive the expiration or termination of this Agreement.
Limitation of City’s Liability. 5.1. The obligations of the City pursuant to this Agreement are restricted solely to the lending of the Principal in the manner described in Article 3, and performance by the City of its obligations under this Agreement.

Limitation of City’s Liability. No representation, agreement or provision contained in this Agreement, the Assignment or the Disbursing Agreement nor any other agreement, covenant or undertaking by the City contained in any document executed by the City in connection with the Facilities or the Project or the issuance of the Note shall give rise to any pecuniary liability of the City or a charge against its general credit or taxing powers, or shall obligate the City financially in any way other than the payments to be made by the Borrower under this Agreement pledged to the Lender. No failure of the City to comply with any term, representation, condition, covenant or agreement herein shall subject the City to liability for any claim for damages, costs or other financial or pecuniary charge; and no execution of any claim, demand, cause of action or judgment shall be levied upon or collected from the general credit, general funds or taxing powers of the City. Nothing herein shall preclude a proper party in interest from seeking and obtaining specific performance against the City for any failure to comply with any term, condition, covenant or agreement herein; provided that no costs, expenses or other monetary relief shall be recoverable from the City except as may be payable from the payments to be made by the Borrower under this Agreement pledged to the Lender.

All of Licensee’s personal property, and any personal property of any Subcontractor, or any sublicensee (if any) upon the Licensed Space or upon any other part of the Cultural Center, is present solely at the risk of Licensee, or its Subcontractors, or sublicensees (as applicable), and the City shall not be liable for any loss or damage to such personal property or theft of such personal property. The City is not liable or responsible to Licensee, and Subcontractors, and sublicensees, and Licensee waives, and will cause its Subcontractors and sublicensees (if any) to waive, to the fullest extent permitted by law, all claims against the City for any loss or damage or inconvenience to any property or person or any lost profits any or all of which may have been occasioned by or arisen out of any event or circumstance, including (i) theft, fire, act of God, public enemy, injunction, riot, strike, insurrection, war, court order, requisition or order of governmental body or authority, or water leakage, steam, excessive heat or cold, falling plaster, or broken glass, or (ii) any act or neglect of the City or any occupants of the Cultural Center, or the Licensed Space, or (iii) repair or alteration of any part of the Cultural Center or the Licensed Space, or failure to make any such repairs, (iv) or any other thing or circumstance, whether of a like nature or a wholly different nature. If the City fails to perform any covenant or condition of this Agreement that the City is required to perform and, notwithstanding the foregoing, Licensee recovers a money judgment against the City, the judgment must be satisfied only out of credit against the Fees and other monies payable by Licensee to the City under this Agreement.
Limitation of City’s Liability. 11 If City terminates this License other than as of right as provided in this License, or City 12 causes interruption of the business of Licensee or for any other reason City breaches this 13 License, the liability of City, its officials, officers, employees, agents, or volunteers, for damages 14 to Licensee, whether arising in contract, tort (including negligence) or otherwise, shall be 15 limited to the actual and direct costs of equipment removal and shall specifically exclude any 16 recovery for incidental, special, punitive, or consequential damages of any kind (including, 17 without limitation, loss of income, loss of business, loss of profits, diminished value of the 18 business as a going concern, future expectation of profits, or other pecuniary loss or related 19 damage to Licensee).
