Common use of Limitation on Contract Amount Increases Clause in Contracts

Limitation on Contract Amount Increases. Any increase in the Contract Amount allowed hereunder shall exclude: (a) Costs caused by breach of Contract or fault or negligence, or act or failure to act of any Contractor-Related Entity. (b) Costs that could reasonably have been avoided by Contractor, including by re- sequencing, reallocating, or redeploying its forces to other portions of the Work or to other activities unrelated to the Work (including any additional costs reasonably incurred in connection with such reallocation or redeployment). (c) Costs for (i) any rejected Work that failed to meet the requirements of the Contract and (ii) any necessary remedial Work.
