Contractor Right to Request Time Extension and Price Increase. Upon the Contactor’s fulfillment of all applicable requirements of the Contract Documents and subject to the limitations contained therein, the Contractor shall be entitled to a Change Order for a circumstance that increases the Contract Price or extends a Completion Deadline only to the extent the Special Provisions expressly state that such circumstance entitles the Contractor to an equitable adjustment and for the following circumstances (and for no other circumstances):  Any material change in the Directive Drawings is necessary to meet the requirements of the other Contract requirements as a result of an error, omission, inconsistency, inaccuracy, deficiency or other defect in the Directive Drawings, to the extent provided in the “Responsibility of the Contractor for Design” clause (Section 7.3) of the General Provisions;  The Authority requires removal or termination of certain personnel without cause, to the extent provided in the “Removal of Contractor Personnel” clause (Section 4.4) of the General Provisions;  A change in one or more applicable Laws after the date 30 days prior to the Proposal Deadline, to the extent provided in the “Compliance with Law” clause (Section 6) of the General Provisions;  A suspension, termination, interruption or nonrenewal of any Authority-Provided Approval (except for modifications to such approvals or any new such approvals required to allow the Contractor’s design concepts to be incorporated into the Project);  If prior possession or use by the Authority delays the progress of the Work or causes additional expense to the Contractor, to the extent provided in the “Use and Possession Prior to Completion” clause (Section 7.13) of the General Provisions;  Force Majeure, to the extent provided in the “Force Majeure” clause (Section 7.15) of the General Provisions;  Differing Site Conditions, to the extent provided in the “Differing Site Conditions” clause (Section 22) of the General Provisions;  The approved GBR-C materially increases the Contractor’s cost of, or the time required for, performing the Work, as compared to the GBR-B, to the extent provided in the “GBR-C” clause (Section 22.2) of the General Provisions.  The Authority’s viewing of the location, to the extent provided in the “Notification to the Authority” clause (Section 34.1) of the General Provisions, exceeds three Working Days;  A suspension for convenience, to the extent provided in the “Suspension for Convenience” clause (Section 39.2) of t...

  • Requesting Price Increase/Required Documentation Contractor must submit a written notification at least thirty (30) calendar days prior to the requested effective date of the change, setting the amount of the increase, along with an itemized list of any increased prices, showing the Contractor’s current price, revised price, the actual dollar difference and the percentage of the price increase by line item. Price change requests must include H-GAC Forms D Offered Item Pricing and E Options Pricing, or the documentation used to submit pricing in the original Response and be supported with substantive documentation (e.g. manufacturer's price increase notices, copies of invoices from suppliers, etc.) clearly showing that Contractor's actual costs have increased per the applicable line item bid. The Producer Price Index (PPI) may be used as partial justification, subject to approval by H-GAC, but no price increase based solely on an increase in the PPI will be allowed. This documentation should be submitted in Excel format to facilitate analysis and updating of the website. The letter and documentation must be sent to the Bids and Specifications manager, Xxxxxxx Xxxxxx, at Xxxxxxx.Xxxxxx@x-xxx.xxx Review/Approval of Requests If H-GAC approves the price increase, Contractor will be notified in writing; no price increase will be effective until Contractor receives this notice. If H-GAC does not approve Contractor’s price increase, Contractor may terminate its performance upon sixty (60) days advance written notice to H-GAC, however Contractor must fulfill any outstanding Purchase Orders. Termination of performance is Contractor’s only remedy if H-GAC does not approve the price increase. H-GAC reserves the right to accept or reject any price change request.

  • Extension of time for completion (i) Without prejudice to any other provision of this Agreement for and in respect of extension of time, the Contractor shall be entitled to extension of time in the Project Completion Schedule (the “Time Extension”) to the extent that completion of any Project Milestone is or will be delayed by any of the following, namely:

  • EXTENSION OF USE COMMITMENT The Contractor agrees to honor all orders from State Agencies, political subdivisions and others authorized by law (see Section 25 Extension of Use) which are in compliance with the pricing, terms, and conditions set forth in the Contract. Any unilateral limitations/restrictions imposed by the Contractor on eligible Authorized Users will be grounds for cancellation of the Contract.

  • Time Extension CONTRACTOR shall provide a time extension request on completion of Task Order for delays caused by others (Permitting Agencies, COUNTY or Contract Cities, or unforeseen conditions such as inclement weather, etc.) and at no fault by CONTRACTOR, subject to approval by COUNTY. COUNTY will review the request and determine in its sole discretion whether the situation warrant a time extension at no-cost or with costs. If CONTRACTOR completes the Task Order beyond the stipulated completion date without COUNTY’s specific written approval for time extension, CONTRACTOR will be subject to liquidated damages and may be construed as non-responsive, which may affect CONTRACTOR for considerations for future Task Orders or projects.

  • CONTRACTOR’S SUBMISSION OF CONTRACT MODIFICATIONS In connection with any Contract modification, OGS reserves the right to:  request additional information  reject Contract modifications  remove Products from Contract modification requests  request additional discounts for new or existing Products

  • Extended Work Year A teacher requested by the Board to work in his/her regular assignment beyond the contracted number of days shall be offered an extended contract and compensated at the scheduled per diem rate, as specified in Article XXV. Compensation for weeks worked after July 1 shall be at the new rate.

  • Amendments; Renewal Any amendments, consents to or waivers of the terms of this Contract must be in writing and signed by both parties. The parties may renew this Contract by their signed, written instrument.

  • DISTRIBUTION OF CONTRACTOR PRICE LIST AND CONTRACT APPENDICES Contractor shall provide Authorized Users with electronic copies of the Contract, including price lists and Appendices, upon request. OGS CENTRALIZED CONTRACT MODIFICATIONS Contract Updates will be handled as provided in Appendix C – Contract Modification Procedures.

  • TAM Extension Service The TAM Extension Service is an extension of a Red Hat Enterprise Linux TAM Service to provide additional technical knowledge such as SAP implementations on Red Hat Enterprise Linux. The TAM Extension Service requires a separate active and paid standard TAM Service Subscription.

  • Time for Commencement and Completion The term (Initial Term) of this Agreement will begin on the Effective Date and expire on ______________________, 20___. University will have the option to renew this Agreement for _______ (___) additional ______ (____) year terms (each a Renewal Term). The Initial Term and each Renewal Term are collectively referred to as the Term.
