Common use of Limitation on Modifications Clause in Contracts

Limitation on Modifications. (a) The Company shall not amend, modify, waive or otherwise change any provision of the Company Operating Agreement without the prior written consent of the Majority Holders. (b) The Company shall not amend, modify, waive or otherwise change any provision of the MBIA Facility without the prior written consent of the Majority Holders. (c) The Company shall not amend, modify, waive or otherwise change any provision of the Subordinated Facility without the prior written consent of the Majority Holders.

Limitation on Modifications. (a) The Company shall not amend, modify, waive or otherwise change any provision of the Company Operating Agreement without the prior written consent of the Majority Holdersholders of a majority in aggregate principal amount of the then outstanding Senior Notes. (b) The Company shall not amend, modify, waive or otherwise change any provision of the MBIA Facility without the prior written consent of the Majority Holders. (c) The Company shall not amend, modify, waive or otherwise change any provision holders of a majority in aggregate principal amount of the Subordinated Facility without the prior written consent of the Majority Holdersthen outstanding Senior Notes.
