Limitation on Offering Materials. The Company has not prepared, made, used, authorized, approved or distributed and will not, and will not cause or allow its agents or representatives to, prepare, make, use, authorize, approve or distribute any written communication that constitutes an offer to sell or a solicitation of an offer to buy the Offered Securities, or otherwise is prepared to market the Offered Securities, other than (i) the General Disclosure Package, (ii) the Final Offering Circular and (iii) any Supplemental Marketing Materials used in accordance with Section 5(a) hereof.
