Limitation On Relief Awardable. The sole forms of relief awardable by the arbitrators shall be to: issue a declaratory judgment on the construction and/or interpretation of any clause in the Agreement; and/or award actual money damages plus, if the arbitrator deems appropriate, pre-award and post award interest at the prime rate, as reported in the Wall Street Journal, Western Edition, plus 100 basis points, from the time when such amounts became due until paid. The arbitrator shall have no authority or power to grant, and no party shall seek, any award of punitive or exemplary or like damages.

Limitation On Relief Awardable. The sole forms of relief awardable by the arbitrator shall be to: compel either party to specifically perform the obligations under the Agreement; issue a declaratory judgment on the interpretation of any clause in the agreement; order cancellation or reformation of the Agreement; and/or award actual money damages plus, if the arbitrator deems appropriate, pre-award and post-award interest at a rate of eight percent (8%) per year or at the prime rate of interest in effect at the time and place of the award, whichever is less. Each party shall bear an equal share of the cost of arbitration, except that the expenses of witnesses shall be borne by the party producing such witnesses. Each party shall pay their own attorney’s fees.
