Limitations on DataBank Clause Samples

Limitations on DataBank. All Customer Equipment installed or located in the DataBank Data Center shall remain the property of Customer and shall never be deemed a fixture to any real property owned by DataBank or any third party, except as expressly set forth in this Addendum. Except as expressly provided herein, nothing in the Agreement shall give or convey to DataBank any, right, title or interest in the Customer Equipment. DataBank shall not have the power, authority or right to create and shall not permit any lien or encumbrance, including without limitation, tax liens, mechanics’ liens, or other liens or encumbrances to be placed on the Customer Equipment or other Customer property in the Space or in any DataBank Data Center.
