Common use of Limited Performance Warranty Clause in Contracts

Limited Performance Warranty. Famic represents and warrants that:  The HS are provided on its own Infrastructure or on the Infrastructure of third-party providers with whom Famic has agreements for such services.  Famic will devote reasonable commercial efforts to maintain both the availability and quality of the HS offered. Notwithstanding any warranty applicable to such services, Famic hereby disclaims all representations and makes no warranties or conditions of any kind, whether expressed, implied (either in fact or by operation of Law) or statutory, including without limitation, all warranties or conditions of merchantability, fitness for a particular purpose, and all warranties that may arise from course of dealing, course of performance or usage of trade. Famic does not warrant that any use of or access to the services offering will be error-free, complete or secure. No oral or written representations, information or advice given by Famic, its dealers, distributors, agents or employees, shall create a warranty or in any way increase the scope of this Limited Performance Warranty and User may not rely on any such representations, information or advice.

Notwithstanding any warranty applicable to such services, Famic hereby disclaims all representations and makes no warranties or conditions of any kind, whether expressed, implied (either in fact or by operation of Law) or statutory, including without limitation, all warranties or conditions of merchantability, fitness for a particular purpose, and all warranties that may arise from course of dealing, course of performance or usage of trade.
