Common use of Limited Waiver of Implied Warranties Clause in Contracts

Limited Waiver of Implied Warranties. With respect to claims other than Unrestricted Claims (“Restricted Claims”), any and all implied warranties, if any (including, without limitation, any implied warranty of merchantability and any implied Warranty of fitness for a particular purpose) shall be deemed to have been waived. This limited waiver shall not be construed as a waiver or disclaimer of such warranties for any other purpose and shall not restrict the rights of UFPC and/or Participants to assert Unrestricted Claims against Distributor for breach of any implied warranties.
