Common use of LIMITED WARRANTY POLICY Clause in Contracts

LIMITED WARRANTY POLICY. (a) Subject to the exceptions set forth in the paragraphs below, if the End User finds the SOFTWARE to be defective, STATCREW will replace it, free of charge (or, at STATCREW's op- tion, refund the purchase price) provided that all copies are completely erased from all com- puters it was installed on, and that the original product and all copies are returned to STATCREW within 30 days from the date of original purchase by the End User. This shall constitute the sole and entire remedy against STATCREW. STATCREW shall not assume liabil- ity for any further damages including, but not by way of limitation, lost profits or other indi- rect or direct consequential damages arising from the End User's use of or inability to use the SOFTWARE.
