Limited Warranty Exclusions. This Limited Warranty describes the service available to you if your product requires warranty service, and you may have additional protections under your local laws. This Limited Warranty does not cover and excludes damage to your product or any component thereof caused by:
4.1 Abuse, misuse, recklessness, negligence, or commercial use.
4.2 Improper charging, storage, maintenance, or operation of the Product not in compliance with instructions or limitations as provided in the user materials.
4.3 Use of the Product not in compliance with applicable laws and regulations.
4.4 Use of the Product by persons with inadequate experience.
4.5 Accident, collision, riding at an unsafe speed on paved roads, riding at an unsafe speed on unpaved roads, riding over obstacles, amateur racing, professional racing, use in backcountry sports, fire damage, water damage, chemical damage, use of the Product outside of the Product’s working temperature range, high-pressure water spray, earthquake, dropping, loading with excessive weights.
4.6 Modifications to mechanical parts, modifications to electronic parts, or modifications to software embedded in the Product.
4.7 Service, repair, and maintenance by unauthorized providers.
4.8 Cosmetic damages.
4.9 Use of the Product with third party product, component, or accessory.
4.10 The normal deterioration of wear and tear parts.
4.11 Use of the Product with overdue wear and tear parts.
Limited Warranty Exclusions. This limited warranty is subject to the following limitations:
a. any implied warranties, guarantees or conditions not able to be disclaimed as a matter of law will last one year from the start of the limited warranty;
b. this limited warranty does not cover problems caused by accident, abuse or use of the Products in a manner inconsistent with this Agreement, or resulting from events beyond our reasonable control;
c. this limited warranty does not apply to problems caused by the failure to meet minimum system requirements; and
d. this limited warranty does not apply to Previews or free offerings.
Limited Warranty Exclusions. The Limited Warranties given in respect of a Product do not apply in the following circumstances:
a) the serial number of a Product is removed, altered or is illegible;
b) the Product is moved to a location other than its original installation location;
c) the Product has been installed or subject to use in a location that is within 5 meters of a saline water body or the Product, in Silfab’s absolute judgement, may otherwise be subject to direct contact with salt water (including without limitation as a result of immersion, waves or salt spray);
d) the Product is used in a mobile application, including without limitation by installing the Products on any vehicle or craft;
e) the Products is used in combination with any device for concentrating or magnifying light or with any solar thermal system;
f) the Product is not installed with strict adherence to the instructions specified in Silfab’s Installation and Maintenance Manual;
g) the Products is modified, serviced or repaired by any person other than Silfab or a third party approved in advance by Silfab;
h) The product is clearly marked as “no warranty” (typically but not exclusively by stamp on the cover of the junction box).
i) in respect of cosmetic damage (including without limitation scratches, dents, corrosion, paint chipping, and discoloration) that does not affect power output;
j) in respect of damage that is caused by any of the following:
i. any transportation, storage, installation, wiring, interconnection, operation, cleaning or maintenance of the Products other than in accordance with (i) specifications, installation manuals, operational manuals, or labels attached to the Products; or (ii) applicable laws, including without limitation any local electrical codes;
ii. misuse, neglect, tampering, vandalism or accident by any person other than Silfab;
iii. incompatibility with, or malfunctioning of, or other damage caused by, the systems, devices or components to which the Products are connected or mounted;
iv. abrasions, tears or punctures of the Products by tools, by mounting hardware or by other components, structures, or natural features (e.g., tree branches) that come into contact with the Products;
v. mechanical shock caused by objects or persons falling on, stepping on, bumping into or otherwise colliding with the Products or with the systems, devices or components to which the Products are connected or mounted;

a. Products sold and/or installed outside the United States of America or any of the USA territories or possessions, or Bermuda, or Caribbean except Cuba.
b. Expiration of warranty, no registration (if making a claim under an extended warranty), no evidence of purchase, or no proof of installation by a qualified licensed solar or electrical contractor.
c. Altered, removed, or illegible Product serial number(s).
d. Any Product repaired by anyone other than Panasonic USA.
e. Cosmetic variations, stains or scratches that do not affect power output.
f. Marine (e.g. boats), recreation vehicle, or mobile installations of any kind. Multi-axis tracking systems are not considered mobile installations.
g. Improper applications, such as, but not limited to, use with mirrors, concentrated sunlight, and contact with solar thermal systems.
h. Damage due to lack of compliance with the General Installation Manual, national or local codes, such as the National Electric Code, or any authority having jurisdiction.
i. Damage or corrosion resulting from environmental pollution such as soot, chemical vapors, acid rain, direct contact with saltwater such as ocean spray, immersion in water, whether caused by flooding or otherwise, and any type of mold.
j. Damage from sound, vibration, rust, scratches, or discoloration that is the result of normal wear and tear, aging or continuous use.
k. Damage caused by inadequate or improper usage, alteration, installation, wiring, handling, removal, maintenance, storage, packaging, transportation.
l. Claims made more than one year from the date the Owner knew or should have known about the alleged power output degradation, or product workmanship defect.
m. Damage caused by abuse, neglect, vandalism, accident, animals or insects, or external stress, such as, but not limited to, stepping on Product, impacts from falling objects such as tools, golf balls, rocks, hailstones, or other debris.
n. Damage from non-compatibility with, or defects in, system-related parts and components.
o. Damage from extreme natural conditions such as earthquakes, typhoons, tornados, volcanic activity, tsunami, lightning, heavy snow or ice, fire, or other unforeseen circumstances.
p. Damage to the backsheet such as, but not limited to, cuts, scrapes, scratches, punctures, penetrations, or wear and tear, from objects such as, screws, bolts, nails, tools, sys...
Limited Warranty Exclusions. The warranties above in Sections 2 and 3 are void and do not apply under the following:

Products sold and/or installed outside the United States; provided, however, that any Products sold and/or installed in any of the American territories located in the Pacific Ocean (including American Samoa, Saipan, Guam), or in any island nation and territory located in the Caribbean Sea, except Cuba, are covered by the warranties in Sections 2 and 3 above.

Limited Warranty Exclusions. 6.1 Limited Program Warranty Except as excluded pursuant to section 8.2 herein, Practifi warrants that the Practifi Application will function substantially as described in the Documentation and as otherwise represented to You from time to time. All software and services provided may contain errors, and you acknowledge that use of any software service entails the likelihood of some human and machine errors, omissions, delays, interruptions, and losses, including inadvertent loss of data. Accordingly, Practifi makes no warranty that the Practifi Application is error-free and makes no warranty or representation that the Practifi Application will be free of interruptions due to Salesforce, third-party hosting services, Internet outages and the like. Practifi will implement fixes to any errors that comes to Practifi’s attention promptly and without delay and will comply with the service levels contained in the Master Support Agreement (Appendix C).

b) Damage or failure of the Module(s) caused by non-compliance with federal, state, and/or local electric codes; or
c) Damage or failure of the Module(s) caused by installation not in conformance with the Module(s) specifications, installation manuals, operation manuals, or labels attached to the Module(s); or
d) Damage or failure of the Module(s) caused by improper wiring, installation, or handling; or
e) Damage or failure of the Module(s) caused by devices and/or parts not authorized by LG or by mounting methods of such unauthorized devices and/or parts; or
f) Damage or failure of the Module(s) caused by improper or incorrectly performed maintenance, operation, alteration, or modification; or
g) Damage or failure of the Module(s) caused by removal from the original place of installment; or
h) Damage or failure of the Module(s) caused by repairs not in accordance with LG’s instructions; or
i) Damage or failure of the Module(s) caused by inappropriate handling during storage, packaging, or transportation; or
j) Damage or failure of the Module(s) caused by external shock such as flying objects or external stress; or
k) Damage or failure of the Module(s) caused by direct contact with environmental pollution such as soot, acid rain, or industrial chemicals including ammonia; or
l) Damage or failure of the Module(s) caused by direct contact with salt water or underground water containing lime component or petrochemicals; or
m) Damage or failure of the Module(s) caused by acts of nature (e.g., earthquake, tornado, flood, lightning, fire, hurricane, heavy snow, etc.) or caused by power failure, power surge, or any other unforeseen circumstance beyond LG’s control; or
n) Damage or failure of the Module(s) caused by an act of terror, riot, war, or other man-made disaster; or
