Common use of List of Holders Clause in Contracts

List of Holders. (a) The Guarantor shall furnish or cause to be furnished to the Guarantee Trustee (a) semiannually, on or before May 15 of each year, a list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders (a “List of Holders”) as of a date not more than 15 days prior to the delivery thereof, and (b) at such other times as the Guarantee Trustee may request in writing, within 30 days after the receipt by the Guarantor of any such request, a List of Holders as of a date not more than 15 days prior to the time such list is furnished, in each case to the extent such information is in the possession or control of the Guarantor and has not otherwise been received by the Guarantee Trustee in its capacity as such. Notwithstanding the preceding sentence, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

Notwithstanding the preceding sentence, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. Notwithstanding the preceding sentence, the Guarantor Sponsor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the GuarantorSponsor, and (ii) at any other time, within 30 days of receipt by the Trust of a written request from the Guarantee Trustee for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Guarantee Trustee. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it; provided that the Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. Notwithstanding the foregoing, the Guarantor shall not be obligated to provide such List of Holders at any time the Preferred Securities are represented by one or more Global Certificates (as defined in the Trust Agreement). (b) The Guarantee Trustee shall comply with the requirements of its obligations under Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

List of Holders. (a) The Guarantor and the Administrators on behalf of the Trust shall furnish or cause to be furnished to provide the Guarantee Trustee (ai) semiannually, on or before May 15 within 1 Business Day after each record date for payment of each yeardistributions, a list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Securities (a “the "List of Holders”") as of a date not more than 15 days prior to the delivery thereofsuch record date; provided, and (b) at such other times as the Guarantee Trustee may request in writing, within 30 days after the receipt by that neither the Guarantor of any such request, a List of Holders as of a date not more than 15 days prior to nor the time such list is furnished, in each case to the extent such information is in the possession or control Administrators on behalf of the Guarantor and has not otherwise been received by the Guarantee Trustee in its capacity as such. Notwithstanding the preceding sentence, the Guarantor Trust shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the GuarantorGuarantor and the Administrators on behalf of the Trust, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders, a List of Holders 8 as of a date no more than 14 days before such List of Holders is given to the Guarantee Trustee. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it; provided, that the Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of Section its obligations under Sections 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

List of Holders. (a) The Guarantor shall furnish or cause to be furnished to the Guarantee Trustee (a) semiannually, on or before May 15 June 30 and December 31 of each year, a list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders (a “"List of Holders”") as of a date not more than 15 days prior to the delivery thereof, and (b) at such other times as the Guarantee Trustee may request in writing, within 30 days after the receipt by the Guarantor of any such request, a List of Holders as of a date not more than 15 days prior to the time such list is furnished, in each case to the extent such information is in the possession or control of the Guarantor and has not otherwise been received by the Guarantee Trustee in its capacity as such. Notwithstanding the preceding sentence, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act. Pursuant to Section 312(c) of the Trust Indenture Act, the Guarantee Trustee shall not be held accountable by reason of the disclosure of any information under Section 312(b) of the Trust Indenture Act.

List of Holders. (a) The Guarantor shall furnish or cause to be furnished to the Guarantee Trustee (a) semiannually, on or before May December 15 of each year, a list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders (a “List of Holders”) as of a date not more than 15 days prior to the delivery thereof, and (b) at such other times as the Guarantee Trustee may request in writing, within 30 days after the receipt by the Guarantor of any such request, a List of Holders as of a date not more than 15 days prior to the time such list is furnished, in each case to the extent such information is in the possession or control of the Guarantor and has not otherwise been received by the Guarantee Trustee in its capacity as such. Notwithstanding the preceding sentence, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

Notwithstanding the preceding sentence; provided that, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantor upon written notification to the Guarantee Trustee may destroy any that no such changes in the List of Holders previously given to it on receipt of a new List of Holdershas occurred or at any time the Guarantee Trustee is the Securities Register under the Trust Agreement. (b) The Guarantee Trustee shall comply with the requirements of Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

List of Holders. Notwithstanding the preceding sentenceforegoing, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does such list would not differ from the most recent List of Holders given last list provided pursuant to the Guarantee Trustee by the Guarantorthis Section 2.2(a). The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of its obligations under Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

List of Holders. (a) The Guarantor and the Administrators on behalf of the Issuer shall furnish or cause to be furnished to provide the Guarantee Trustee (ai) semiannually, on or before May 15 within 1 Business Day after each record date for payment of each yearDistributions, a list, in such form as the Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Capital Securities (a “the "List of Holders”") as of a date not more than 15 days prior to the delivery thereofsuch record date; provided, and (b) at such other times as the Guarantee Trustee may request in writing, within 30 days after the receipt by that neither the Guarantor of any such request, a List of Holders as of a date not more than 15 days prior to nor the time such list is furnished, in each case to the extent such information is in the possession or control Administrators on behalf of the Guarantor and has not otherwise been received by the Guarantee Trustee in its capacity as such. Notwithstanding the preceding sentence, the Guarantor Issuer shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the GuarantorGuarantor and the Administrators on behalf of the Issuer, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders, a List of Holders as of a date no more than 14 days before such List of Holders is given to the Guarantee Trustee. Notwithstanding the preceding sentence, record date; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the GuarantorSponsor, and (ii) at any other time, within 30 days of receipt by the Trust of a written request from the Guarantee Trustee for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Guarantee Trustee. The Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it; provided that the Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. Notwithstanding the foregoing, the Guarantor shall not be obligated to provide such List of Holders at any time the Preferred Securities are represented by one or more Global Preferred Securities (as defined in the Trust Agreement). (b) The Guarantee Trustee shall comply with the requirements of its obligations under Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.

List of Holders. Notwithstanding the preceding sentence, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Guarantee Trustee by the Guarantor. The Guarantee Trustee may destroy any List of Holders previously given list furnished to it on as provided in this Section 2.2(a) upon receipt of a new List of Holderslist so furnished. (b) The Guarantee Trustee shall comply with the requirements of Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act. (c) Every Holder agrees with the Guarantor and the Guarantee Trustee that neither the Guarantor nor the Guarantee Trustee nor any agent of either of them shall be held accountable by reason of any disclosure of information as to names and addresses of Holders made pursuant to the Trust Indenture Act.

List of Holders. Notwithstanding the preceding sentenceforegoing, the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from Preferred Securities are represented by one or more certificates representing Global Securities (as defined in the most recent List of Holders given to the Guarantee Trustee by the GuarantorIndenture). The Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders. (b) The Guarantee Trustee shall comply with the requirements of its obligations under Section 311(a), Section 311(b) and Section 312(b) of the Trust Indenture Act.
