Common use of Listing on Exchange Clause in Contracts

Listing on Exchange. If the Subordinated Debentures are to be issued as a Global Security in connection with the distribution of the Subordinated Debentures to the holders of the Preferred Securities issued by the Trust upon the dissolution of the Trust, the Company will use its best efforts to list such Subordinated Debentures on the American Stock Exchange or on such other exchange as the Preferred Securities are then listed.
