Common use of Listing Period Extension Clause in Contracts

Listing Period Extension. The commencement of the Listing Period shall be extended one (1) day for each day that the Seller fails to provide Broker with the information required to list the Property in the multiple listing service (“MLS”), however, after the 5th calendar day that Seller has failed to provide Broker with the requested (required) information, Broker shall have the option of terminating the Listing Agreement upon written notice to Seller. So long as Seller has failed to provide Broker with requested (required) information, Broker shall not be obligated to list the Property in the MLS and Seller shall indemnify Broker for any costs, expenses or fees incurred as a result of Broker not posting the Property in the MLS. The Seller may terminate the Listing Agreement at any time without penalty by notifying Broker in writing via email, however, any previously paid fees are non-refundable. Once a termination request is made by Seller and received by Broker, the listing will be cancelled within 24 hours. Seller shall be responsible for any cancellation fees charged by the MLS.
