Common use of Litigation Notice Clause in Contracts

Litigation Notice. Give the Bank prompt notice of (i) any action, suit or proceeding known to the Company at law or in equity or by or before any governmental instrumentality or other agency which, if adversely determined, would materially impair the right or ability of the Company to carry out its obligations under this Agreement, the Notes, the Depositary Agreement, the Fuel Lease or the Security Agreement or would materially affect its business, operations, properties, assets or condition, financial or otherwise and (ii) receipt of any notice from the Lessee which the Lessee is required to provide to the Company pursuant to Sections 18, 19 or 20 of the Fuel Lease.
