Common use of LOCAL BUSINESS AND EMPLOYMENT Clause in Contracts

LOCAL BUSINESS AND EMPLOYMENT. 15.1 The Lessor acknowledges that the Lessee seeks to promote employment and business opportunities for local residents and firms on all Lessee contracts. The Lessor will, to the extent legally possible, solicit applications for employment, and bids and proposals for subcontracts, for work associated with this Agreement from local residents and firms as opportunities occur. The Lessor agrees to hire qualified local residents and firms whenever feasible. 15.2 The Lessor understands that failure to comply with the above requirements, and/or submitting false information in response to these requirements, may result in termination of this Agreement, and/or suspension from participating in future City contracts as a Lessor for a period of not less than one (1) year. For additional or subsequent violation, the period of suspension may be extended for a period of up to three (3) years. Failure to satisfy penalties imposed pursuant to this section shall prohibit the Lessor from participating in future City contracts until all penalties have been satisfied. 15.3 Upon the City’s request, the Lessor agrees to provide to the City, within sixty (60) calendar days, a truthful and complete list of the names of all Subconsultants, vendors, and suppliers that the Lessor has used in the past five years on any of its contracts that were undertaken within San Diego County, including the total dollar amount paid by the Lessor for each subcontract or supply contract. The Lessor further agrees to fully cooperate in any investigation conducted by the City pursuant to the City’s Nondiscrimination in Contracting Ordinance (Municipal Code sections 22.3501-22.3517). The Lessor understands and agrees that violation of this clause shall be considered a material breach of the contract and may result in remedies being ordered against the Lessor up to and including contract termination, debarment, and other sanctions for violation of the provisions of the City’s Nondiscrimination in Contracting Ordinance. The Lessor further understands and agrees that the procedures, remedies, and sanctions provided for in the City’s Nondiscrimination in Contracting Ordinance apply only to violations if said City’s Nondiscrimination in Contracting Ordinance.
