Common use of Location of Operations Clause in Contracts

Location of Operations. The MCO is required to have a physical presence in West Virginia, including: ensuring at least eighty (80) percent of its total full-time equivalent positions allocated to manage care individuals covered under this contract have a primary work place in the state of West Virginia and the operation of call center services is in a West Virginia location. The MCO must notify the Department forty-five (45) calendar days in advance of any proposal to modify claims operations and processing, enrollee services, or case management processes that may include the relocation of operations. The MCO must be responsible for any costs incurred by other contracted vendors of the Department for required updates needed as a result of such change.
