Common use of Long Stop Date Clause in Contracts

Long Stop Date. ‌ (a) Unless FBR grants upon a prior written request of the Concessionaire an extension in the Project Completion Schedule for verifiable and justifiable reasons suggesting and proving the inability of the Concessionaire to complete the Project as per Project Completion Schedule, the Concessionaire shall be bound to achieve the completion of, and entry into the commercial operations of, the Project within [•] Days from the service of notice under Section 14.5. (b) Failure of the Concessionaire to achieve the completion and entry of the Project into the commercial operations within [•] Days or on or before the period of extension shall entitle FBR to terminate the Agreement under Section 21 (Termination) of the Agreement, unless such delay, default or breach has not been occasioned due to the factors of Force Majeure necessitating the Relief Events.
