Common use of LOST, STOLEN OR DESTROYED EQUIPMENT Clause in Contracts

LOST, STOLEN OR DESTROYED EQUIPMENT. In the event that after delivery to Customer, any of the Equipment is lost, stolen, damaged beyond repair, destroyed or otherwise disappears or is not returned for any reason, Customer will be responsible for the cost to replace the same item or the closest comparably equipped model, at current retail prices less any discounts available, without deduction for depreciation. AS SOON AS CUSTOMER REALIZES THAT EQUIPMENT IS MISSING, NOTIFY THE RENTAL COMPANY AND FILE A POLICE REPORT. In all instances immediately report any missing, lost, or stolen Equipment to the Rental Company and file a report with the local authorities. RENTAL CHARGES AND LATE CHARGES CUSTOMER MUST RETURN THE EQUIPMENT ON THE DATE SPECIFIED in the Rental Contract or be subject to additional charges. The last rental day shall be the day specified in the Rental Contract or up until 10:00 a.m. of the next business day. A full additional day’s rental will be charged for any Equipment not returned by 10:00 a.m. Full daily rates shall be charged for each day Equipment is not returned after the date specified. DAMAGED EQUIPMENT IF CUSTOMER RETURNS THE EQUIPMENT DAMAGED OR IN NONWORKING CONDITION, the lease period will be extended by the shortest reasonable time necessary to repair such damage or replace nonrepairable Equipment and return the item(s) to the Rental Company’s general inventory. The extended rental period shall apply only to the damaged or nonworking item(s), unless the item(s) forms a part of other equipment. There may be delays in repair or replacement attributable to causes beyond the Rental Company’s control. The acceptance of the return of the Equipment by the Rental Company is not a waiver by the Rental Company of any claims that it may have against you. RENTAL CHARGES FOR THE DAMAGED OR NONWORKING ITEM(S) These items shall accrue at full rental rate for the item(s) irrespective of any package discounts or other discounts agreed to at the inception of the Rental Contract, until the item(s) is repaired and/or replaced and the invoice for the damages has been paid in full to the Rental Company. If requested Customer shall advance the money in order to allow the Rental Company to repair or replace the Equipment.

LOST, STOLEN OR DESTROYED EQUIPMENT. In the event that after delivery to Customer, any of the Equipment Customer shall promptly notify Milestone in writing if a Chassis is lost, stolen or destroyed during the Rental Term. The daily usage charge shall continue to accrue until such time as written notice is received by Milestone and Milestone confirms receipt back in writing to Customer. When a Chassis is lost, stolen or destroyed during the Rental Term, Customer must promptly provide notice to Milestone in accordance with the provisions of Section 25 (Notices) of this Agreement, either by mail, facsimile or email. If stolen, damaged beyond repairCustomer will report the theft to local law enforcement authorities having jurisdiction, obtain a copy of law enforcement’s incident report and provide it to Milestone upon request. If (a) the cost of correcting any damage in any Chassis, or of obtaining and installing parts, equals or exceeds the casualty value of the Chassis as specified in the Casualty Value Schedule annexed hereto as Exhibit A (the “Casualty Value”), (b) the Chassis is detained, confiscated, stolen, lost, destroyed or otherwise disappears damaged beyond economic repair (the cost to repair exceeds the Casualty Value), (c) the Chassis is encumbered, mortgaged, or sold or (d) there is not returned for any reasonother action that affects Milestone’s use and enjoyment of such Chassis, Milestone will have the right to receive from Customer, and Customer will be responsible to pay for, not as a penalty but as payment for the cost loss of the Chassis, the Casualty Value of such Chassis in addition to replace all other charges that are payable hereunder. Customer shall pay to Milestone the same item or Casualty Value of the closest comparably equipped modelChassis within fifteen (15) days of its receipt of a casualty value invoice; provided, at current retail prices less however, that in the event Customer fails to pay Milestone the Casualty Value for any discounts availablesuch Chassis within fifteen (15) days following notice to Customer of the Casualty Value, without deduction for depreciation. AS SOON AS CUSTOMER REALIZES THAT EQUIPMENT IS MISSINGthe subject Chassis shall be put back on-hire, NOTIFY THE RENTAL COMPANY AND FILE A POLICE REPORT. In all instances immediately report any missing, lost, or stolen Equipment retroactive to the Rental Company date it was taken off-hire, and file a report with shall remain on- hire (and Customer shall continue to pay rent therefor) until Customer pays the local authorities. RENTAL CHARGES AND LATE CHARGES CUSTOMER MUST RETURN THE EQUIPMENT ON THE DATE SPECIFIED in the Rental Contract or be subject Casualty Value to additional chargesMilestone. The last rental day shall Casualty Value will be payable in addition to, and will not absolve Customer from the day specified in the Rental Contract or up until 10:00 a.m. payment of, all charges payable by virtue of the next business day. A full additional day’s rental will be charged for any Equipment not returned by 10:00 a.m. Full daily rates shall be charged for each day Equipment is not returned after the date specified. DAMAGED EQUIPMENT IF CUSTOMER RETURNS THE EQUIPMENT DAMAGED OR IN NONWORKING CONDITIONnon-use, the lease period will be extended by the shortest reasonable time necessary to repair such damage or replace nonrepairable Equipment and return the item(s) to the Rental Company’s general inventory. The extended rental period shall apply only to the damaged or nonworking item(s)detention, unless the item(s) forms a part of other equipment. There may be delays in repair or replacement attributable to causes beyond the Rental Company’s control. The acceptance use and/or misuse of the return of Chassis during the Equipment by period from the Rental Company is not a waiver by the Rental Company of any claims that it may have against you. RENTAL CHARGES FOR THE DAMAGED OR NONWORKING ITEM(S) These items shall accrue at full rental rate for the item(s) irrespective of any package discounts or other discounts agreed to at the inception commencement date of the Rental Contract, Term until the item(searlier of (1) is repaired the Return Date of the Chassis, or (2) the payment of the Casualty Value plus all accrued charges, as well as all costs incurred in recovering, and/or replaced and attempting to recover, the invoice for the damages has been paid in full to the Rental Company. If requested Customer shall advance the money in order to allow the Rental Company to repair or replace the EquipmentChassis.
