LOT GRADING AND DRAINAGE. 29.1 Prior to the issuance of a Building Permit for a Lot or Block, the Owner or the Building Permit applicant shall submit to the Town three copies of a proposed Lot Grading Plan prepared by a Professional Engineer or an Ontario Land Surveyor and shall conform to the Subdivision Grading Plan. 29.2 Prior to issuance of a building permit for a Lot or Block, the Owner or the Building Permit applicant shall submit to the Town as security for carrying out the provisions of the Lot Grading Plan a Lot Grading Deposit in the amount of 29.3 Upon acceptance of the Grading Conformance Certificate by the Town, the Owner or the Building Permit applicant may apply in writing for release of the Lot Grading Deposit, less any cost of remedial work performed by the Town. 29.4 The grading of a Lot or Block shall be considered complete when the building has been erected and such Lot or Block has been graded and sodded or hydroseeded. Sodding or hydroseeding shall be done within two months after occupancy of the dwelling or by the next June 1st following occupancy should occupancy take place after November 1st. 29.5 Upon completion of the grading, prior to landscaping or fencing, the Developer shall submit to the Town one copy of the Lot Grading Plan which shall indicate the finished elevation as shown on the proposed Lot Grading Plan. This “as constructed” Lot Grading Plan shall be prepared and certified by a Professional Engineer or Ontario Land Surveyor. 29.6 Once the “as constructed” grading of a Lot has been certified and signed by an Ontario Land Surveyor or Professional Engineer to be in conformance with the latest revision of the Subdivision Grading Plan, the Lot Grading Plan if approved by the Town, shall be accepted and dated by the Town, as the “Grading Conformance Certificate.” 29.7 The Developer, its heirs, executors, administrators, successors and assigns hereby irrevocably undertake to maintain the grading and drainage schemes as established and verified by the Grading Conformance Certificate and not to alter or revise the grading or drainage without the express written consent of the Director of Public Works or the Chief Building Official. 29.8 The Developer agrees that foundation drains shall be pumped by a sump pump in each house discharging via storm laterals. The Developer covenants and warrants that foundation drains will not be connected to the sanitary sewer system. 29.9 The Developer agrees that roof water drainage from any structure or building shall be directed via downspouts discharging via splash pads (concrete or other suitable material) to grass surfaces. These splash pads shall extend a distance at least 1.2 metres away from the structure and must direct the flow away from the building, not onto walks or driveways, and not towards adjacent property. 29.10 If required, the Developer agrees to submit a plan for approval to the Director of Public Works, detailing the basement control elevations for individual dwellings or structures within the Plan of Subdivision and to ensure compliance with approved basement control elevations.

The Municipality agrees that any revisions made to the grading of a lot or block which affects the drainage of such lot or block or other lands after the occupancy of the dwelling unit constructed on such lot or block and after the Owner has completed the grading of such lots or blocks to the satisfaction of the Municipality, shall not be the responsibility of the Owner but shall be the responsibility of the then owner of such lot or block. All building construction within the Subdivision Lands shall be in conformity with the elevation and spot levels shown on the Grading and Drainage Plan approved basement control elevationsby the Municipality. Upon completion of the rough-grading of the Subdivision Lands in accordance with the Grading and Drainage Plan, the Owner shall deliver to the Municipality a plan showing as-constructed elevations and grades for all major xxxxxx and shall deliver a certificate signed by a professional engineer or Ontario Land Surveyor certifying that the rough-grading has been completed in general conformance with the approved plans. For a swale to be considered rough-graded, the swale does not have to be sodded, but shall have been constructed to the approved cross section and to within 75 mm of the elevations on the approved Grading and Drainage Plan. If satisfied with same, the Municipality shall issue an Interim Certificate of Grading Conformity. Upon completion of the final grading of the Subdivision Lands which shall include completion and sodding of all major xxxxxx, in accordance with the Grading and Drainage Plan, the Owner shall deliver to the Municipality a plan showing as- constructed elevations and grades for all major xxxxxx and shall deliver a certificate signed by a professional engineer or Ontario Land Surveyor certifying that the grading works have been completed in strict accordance with the approved plans. If satisfied with same, the Municipality shall issue a Final Certificate of Grading Conformity. In determining whether the Municipality is satisfied with said plan, the Municipality may engage the services of a third-party professional engineer or Ontario Land Surveyor peer reviewer at the Owner’s expense. No building permit will be issued for any lot or block within the Plan until an Interim or Final Certificate of Grading Conformity has been issued and until an individual drainage plan for such lot or block has been submitted to the Municipality showing the proposed final grade elevation, the building location and the immediate points of grade change, all of which must be in conformity with the Grading and Drainage Plan and related road grades. No person shall place or cause or permit to be placed any obstruction whatsoever within the Subdivision Lands or any part thereof which interferes with the drainage of the Subdivision Lands or any part thereof as contemplated by the Grading and Drainage Plan unless the prior written approval of the Municipality is obtained.

This “as constructed” Lot Grading Plan shall be prepared and certified by a Professional Engineer or Ontario Land Surveyor. 29.6 Once the “as constructed” grading of a Lot has been certified and signed by an Ontario Land Surveyor or Professional Engineer to be in conformance with the latest revision of the Subdivision Grading Plan, the Lot Grading Plan if approved by the Town, shall be accepted and dated by the Town, as the “Grading Conformance Certificate.” 29.7 The Developer, its heirs, executors, administrators, successors and assigns hereby irrevocably undertake to maintain the grading and drainage schemes as established and verified by the Grading Conformance Certificate and not to alter or revise the grading or drainage without the express written consent of the Director of Public Works Woks or the Chief Building Official. 29.8 The Developer agrees that foundation drains shall be pumped by a sump pump in each house discharging via storm laterals. The Developer covenants and warrants that foundation drains will not be connected to the sanitary sewer system. 29.9 The Developer agrees that roof water drainage from any structure or building shall be directed via downspouts discharging via splash pads (concrete or other suitable material) to grass surfaces. These splash pads shall extend a distance at least 1.2 metres away from the structure and must direct the flow away from the building, not onto walks or driveways, and not towards adjacent property. 29.10 If required, the Developer agrees to submit a plan for approval to the Director of Public Works, detailing the basement control elevations for individual dwellings or structures within the Plan of Subdivision and to ensure compliance with approved basement control elevations.

LOT GRADING AND DRAINAGE. 29.1 27.1 Prior to the issuance of a Building Permit for a Lot or Block, the Owner or the Building Permit applicant shall submit to the Town City three (3) copies of a proposed Lot Grading Plan noting both existing and proposed grades and the means where by overland flows will be conveyed across the site to accommodate the specific Building design and site topography prepared by a Professional Engineer or an Ontario Land Surveyor and Surveyor. The Lot Grading Plan shall conform to the Subdivision Grading Plan, to the satisfaction of the City, and the Region, where applicable. 29.2 27.2 The Lot Grading Plan will have regard for all adjacent property elevations and drainage and provide elevations and notes for the following: a) Lot corners b) Apron elevations c) Sump pump discharge locations d) Roof leader discharge locations e) Note that the maximum height of the concrete showing on the foundation wall shall not be more than 30.48 cm (12 inches) above the final approved grade elevation. 27.3 Prior to the issuance of a building permit Building Permit for a Lot or Block, the Developer/Owner or the Building Permit applicant shall submit to the Town as City security for carrying out the provisions of the Lot Grading Plan a Lot Grading Deposit in the amount ofPlan. 29.3 27.4 Upon acceptance of the Lot Grading Conformance Certificate by the TownCity, the Developer/Owner or the Building Permit applicant may apply in writing for release of the Lot Grading Deposit, less any cost of remedial work performed by the TownCity. 29.4 27.5 The grading of a Lot or Block shall be considered complete when the building Building has been erected and such Lot or Block Block, including xxxxxx, has been graded and sodded or hydroseededand/or seeded. Sodding or hydroseeding and/or seeding shall be done within two months after occupancy of the dwelling Building or by the next June 1st following occupancy should occupancy take place after November 1st. 29.5 27.6 Upon completion of grading of the grading, Lot or Block prior to landscaping or fencing, the Developer Owner, shall submit to the Town City one copy of the “as constructed” Lot Grading Plan which shall indicate indicating the finished elevation as shown on the proposed Lot Grading Planelevations.
