Common use of Lowest Evaluated Tender Clause in Contracts

Lowest Evaluated Tender. 36.1 Having compared the evaluated prices of Tenders, the Procuring Entity shall determine the Lowest Evaluated Tender. The Lowest Evaluated Tender is the Tender of the Tenderer that meets the Qualification Criteria and whose Tender has been determined to be: a) most responsive to the Tender document; and b) the lowest evaluated price. 37. Procuring Entity's Right to Accept Any Tender, and to Reject Any or All Tenders. 37.1 The Procuring Entity reserves the right to accept or reject any Tender, and to annul the Tendering process and reject all Tenders at any time prior to notification Award, without thereby incurring any liability to Tenderers. In case of annulment, all Tenderers shall be notified with reasons and all Tenders submitted and specifically, tender securities, shall be promptly returned to the Tenderers.
