Common use of Machine Readable Information Clause in Contracts

Machine Readable Information. All information to be provided by GEC pursuant to this Article 10 shall also be produced and provided in an appropriate and agreed electronic form. The Owner shall be responsible for obtaining appropriate software or its use. However, because of the possibility that information and data delivered in machine readable form may be altered, whether inadvertently or otherwise, and the automated conversion of information and data from the system and format used by GEC to an alternate system or format cannot be accomplished without the possibility of inexactitudes, anomalies, and errors, Owner shall use such information in machine readable form at its sole risk, and GEC shall bear no liability for such use. Contractor may retain hard copy originals of documentation delivered to Owner in LIMA/GEC/EPC 43 Confidential Business Information machine-readable form, which hard copy originals shall be referred to and shall govern in the event of any inconsistency between the two. Hard copies of all electronic files shall be provided to the Owner.

The Owner GEC shall be responsible for obtaining appropriate software or its use.
