Common use of Made Available Clause in Contracts

Made Available. “Made Available” shall mean, with respect to any documents or other materials relating to the Acquired Corporations, that such documents or other materials were actually delivered by the Company to Parent or its counsel at least two business days prior to the date hereof or were at all times between 11:59 p.m. Pacific Time on October 27, 2012 and the date hereof located in the electronic data room organized by the Company in connection with the diligence investigation conducted by Parent or were available on XXXXX at least two business days prior to the date of this Agreement.
