Common use of Maintenance of Equipment and Fixtures Clause in Contracts

Maintenance of Equipment and Fixtures. It is mutually agreed and understood that with respect to all equipment and fixtures as exists in the demised premises, the Tenant is responsible for maintaining same in safe working condition. Said equipment and fixtures are deemed to include, but not be limited to, light fixtures, fire alarms, personnel and overhead doors, and fire extinguishers. Tenant agrees to hold harmless, defend, and indemnify Landlord from any and all claims arising from direct, indirect, or consequential injury or damage to any party, either personal or property, which injury or damage may have been a result of Tenant's failure to adequately maintain said equipment and/or fixtures.
