Common use of Management and Non Clause in Contracts

Management and Non. Union Staff shall not perform any of the work normally performed by members of the Bargaining Unit; except in cases of emergency, testing of equipment, or for the purposes of instructing and/or training employees. A situation shall be deemed by the Commission to be emergent when a sudden, unexpected occasion or combination of forces or events demands immediate action or presents an imminent threat of danger to life or property.

The Parties recognize that there are duties that have been historically shared and this article shall not hamper Management’s ability in participating in these duties.
