Common use of Management Certifications Clause in Contracts

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain PCMC employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable PCMC department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the following: Chief Executive Officer; Chief Operating Officer; Chief Financial Officer; Administrator; and Director of Marketing. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Xxxxxx policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Xxxxxx is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

These Certifying Employees shall include, at a minimum, the following: Chief Executive Officer;  President  Chief Operating Officer; Chief Financial Officer; Administrator; and Officer  Vice President  Director of Marketing. Operations  Public Relations/Community Liaison  Billing Manager  Chief of Operations states:  Director of Training, Safety, and Risk Management For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Liberty policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Liberty is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain PCMC KRHS employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable PCMC KRMC, HC, and NOSM department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the following: Executive Vice President and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer; Officer of HC, Executive Vice President and Chief Operating Officer; Medical Officer of KRH, and Executive Vice President and Chief Financial Officer; Administrator; and Director of MarketingStrategy Officer or KRH. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC [insert name of entity] policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC [insert name of entity] is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

These Certifying Employees shall include, at a minimum, the following: the Chief Executive Officer; Chief Operating Officer; Chief Financial Officer; , Medical Director, and Administrator; and Director of Marketing. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Xxxxxxxx Xx Xxx, Inc. policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Xxxxxxxx Xx Xxx, Inc. is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

These Certifying Employees shall include, at a minimum, the following: the Chief Executive Officer; Chief Operating Officer; Chief Financial Officer; Administrator; , the President, the Billing Manager, and the Director of MarketingOperations. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Balboa policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Balboa is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. These Certifying Employees shall include, at a minimum, the following: Chief Executive Officer; , Chief Operating Officer; , Chief Financial Officer; Administrator; , Vice President of Billing, Vice President of Operations, and Director all other members of Marketingsenior management and the leaders of all business units, divisions or departments with operations that relate to the Federal health care programs. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Xxxxxxxxxx-Xxxxxxx Xxxxxx policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Xxxxxxxxxx-Xxxxxxx Xxxxxx is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain PCMC GIS Parties employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable PCMC GIS Party’s department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, include the following: Chief Executive Officer; Chief Operating Officer; Chief Financial Officer; the GIS Medical Director, the GIS Secretary, the GIS Managing Partner, the GIS Practice Administrator; , the GIS Human Resources and Director of MarketingPayroll Director, the GIS Accounts Payable Director, the GIS Billing Supervisor, the GIS Clinical Manager, the GIDE and DCAD Managing Partner(s), and the GIDE and DCAD Clinical Director(s). For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC the GIS Parties’ policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC [GIS/GIDE/DCAD] is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

These Certifying Employees shall include, at a minimum, the following: Chief Executive Officer; Chief Operating Officer; Chief Financial Officer; Administrator; and , Director of MarketingFinancial Services and Human Resources, Director of Business Services, and the Director of Clinical Services. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Toccoa policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Toccoa is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. These Certifying Employees shall include, at a minimum, the followingfollowing for Gardena Hospital, L.P.: Chief Executive Officer; Chief Operating Officer; , Chief Financial Officer; , Patient Care Services Director/Manager, Chief Nursing Officer, and Associate Administrator; . These Certifying Employees shall also include, at a minimum, the following for Avanti Hospitals, LLC: Chief Executive Officer, Chief Financial Officer, Chief Medical Officer, and Director of MarketingChief Compliance Officer. For each Reporting Period, each Certifying Employee shall sign a certification that states: “"I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and PCMC Xxxxxx Valley policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of PCMC Xxxxxx Valley is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement.
