Common use of Manner of control of the Network by ARTC Clause in Contracts

Manner of control of the Network by ARTC. ARTC agrees at all times during the Term to control the Network in a manner which facilitates: (a) compliance by an Operator with the Service Assumptions for each Train Path; and (b) the use by an Operator of the Path Usages, and in so doing ensure (subject to the matters in clause 3.6(a)) that an Operator’s Train which enters the Network in accordance with the Daily Train Plan or is early will exit the Network in accordance with the Daily Train Plan or as otherwise provided for in the Network Management Principles.

Manner of control of the Network by ARTC. ARTC agrees at all times during the Term to control the Network in a manner which facilitates: (a) compliance by an the Operator with the Service Assumptions for each Train Pathrelevant Services Assumptions; and (b) the use by an the Operator of the Path Usages, and in so doing to ensure (subject to the matters in clause 3.6(aclauses 3.1(b) and 3.6(c)(iii)) that an a Operator’s Train which enters the Network in accordance with the Daily Train Plan or is early will exit the Network in accordance with the Daily Train Plan or as otherwise provided for in the Network Management Principles.

ARTC agrees at all times during the Term to control the Network in a manner which facilitates: (a) compliance by an Operator with the Service Services Assumptions for each Train Path; and (b) the use by an Operator of the Path Usages, and in so doing ensure (subject to the matters in clause 3.6(a3.5(a)) that an Operator’s Train which enters the Network in accordance with the Daily Train Plan or is early will exit the Network in accordance with the Daily Train Plan or as otherwise provided for in the Network Management Principles.

Manner of control of the Network by ARTC. ARTC agrees at all times during the Term to control the Network in a manner which facilitates: (a) compliance by an the Operator with the Service Assumptions for each relevant Scheduled Train PathPaths applicable to the Services; and (b) the use by an the Operator of the Path Usagesrelevant Scheduled Train Paths applicable to the Services, and in so doing to ensure (subject to the matters in clause 3.6(a2.1(b)) that an Operator’s Train which enters the Network in accordance with the Daily Train Plan on schedule or is early will exit the Network in accordance with no later than the Daily Train Plan or as otherwise provided for in the Network Management Principlesscheduled time.

Manner of control of the Network by ARTC. ARTC agrees at all times during the Term to control the Network in a manner which facilitates: (a) compliance by an Operator with the Service ServicesService Assumptions for each Train Path; and (b) the use by an Operator of the Path Usages, and in so doing ensure (subject to the matters in clause 3.6(a3.53.6(a)) that an Operator’s Train which enters the Network in accordance with the Daily Train Plan or is early will exit the Network in accordance with the Daily Train Plan or as otherwise provided for in the Network Management Principles.

ARTC agrees at all times during the Term term of this Agreement to control the Network in a manner which facilitates: (a) compliance by an the Operator with the Service Assumptions for each relevant Scheduled Train PathPaths applicable to the Services; and (b) the use by an the Operator of the Path Usagesrelevant Scheduled Train Paths applicable to the Services, and in so doing to ensure (subject to the matters in clause 3.6(a2.1(b)) that an Operator’s Train which enters the Network in accordance with the Daily Train Plan on schedule or is early will exit the Network in accordance with no later than the Daily Train Plan or as otherwise provided for in the Network Management Principlesscheduled time.
