Mass Market. If CUSTOMER is serving an End User with less than four (4) voice grade (DS0) lines or equivalents in any service area covered by this Agreement, the rates applicable to DS0 Wholesale Switch Port Services and DS0 Wholesale Local Voice Platform Services for the Mass Market shall apply.
Mass Market. 4.2.1 From the Effective Date of this Agreement through December 31, 2004, the Mass Market shall be defined as: (i) End Users that CUSTOMER serves with less than four (4) voice grade (DS0) lines or equivalents in Density Zone 1 (as defined by the FCC as of January 1, 1999) where BellSouth’s switch is located in the top 8 Metropolitan Statistical Areas (MSAs) in BellSouth’s region, as specified by the FCC in CC Docket No. 96-98; and (ii) End Users that CUSTOMER serves with any number of voice grade (DS0) lines or equivalents in any remaining service area in BellSouth’s region. 4.2.2 From January 1, 2005, through the remainder of the term of this Agreement, the Mass Market shall be defined as End Users that CUSTOMER serves with less than four (4) voice grade (DS0) lines or equivalents in any service area covered by this Agreement. 4.2.3 Except as set forth in Section 4.4 below, the rates applicable to DS0 Wholesale Switch Port Services and DS0 Wholesale Local Platform Services for the Mass Market, as set forth in Exhibit A hereto, shall apply to Services provided by CUSTOMER to Mass Market End Users as described in this Section 4.2.

  • Nasdaq National Market The Common Stock is listed on the Nasdaq National Market System, and there are no proceedings to revoke or suspend such listing.

  • Nasdaq National Market Listing The shares of Parent Common Stock issuable to the Company stockholders pursuant to this Agreement shall have been authorized for listing on the Nasdaq National Market upon official notice of issuance.

  • Bulletin Board The Employer shall provide a bulletin board which shall be placed so that all employees will have access to it and upon which the Union shall have the right to post notices of regular meetings, special meetings, seminars or Union activities.

  • NYSE The outstanding shares of Common Stock and the Securities to be sold by the Company hereunder have been approved for listing, subject only to official notice of issuance, on the NYSE, and are registered pursuant to Section 12(b) of the Exchange Act, and the Company has taken no action designed to, or likely to have the effect of, terminating the registration of the Securities under the Exchange Act or delisting any such securities from the NYSE, nor has the Company received any notification that the Commission or the NYSE is contemplating terminating such registration or listing.

  • Bulletin Boards The Employer shall provide bulletin board facilities for the exclusive use of the Union, the sites to be determined by mutual agreement. The use of such bulletin board facilities shall be restricted to the business affairs of the Union.

  • Nasdaq Until the consummation of a Business Combination, the Company will use its best efforts to maintain the listing of the Public Securities on Nasdaq or a national securities exchange acceptable to the Representative.

  • Nasdaq Stock Market The Public Securities have been authorized for listing, subject to official notice of issuance and evidence of satisfactory distribution, on The Nasdaq Stock Market (the “Nasdaq”), and the Company knows of no reason or set of facts that is likely to adversely affect such authorization.

  • Bulletin Board Space 34.01 The Employer shall provide bulletin boards to be placed in reasonably accessible locations upon which designated space shall be provided where the Union may be permitted to post notices of meetings and other such notices which may be of interest to Employees. It is not the intention of the Union to post anything objectionable to the Employer.

  • DIRECT MARKETING Prior to the introduction of any new product or service which Competitive Supplier may wish to make available to Participating Consumers or other Eligible Consumers located within the Town, Competitive Supplier agrees to (i) give the Town written notice of such new product or service and (ii) subject to the entry into reasonable confidentiality terms to the extent permitted by law and mutually acceptable to the Parties, discuss with the Town the possible inclusion of such new product or service in this aggregation program. The Parties agree to negotiate in good faith the terms, conditions, and prices for such products and services which the Parties agree should be included in a Town aggregation program. Competitive Supplier also agrees not to engage in any direct marketing to any Participating Consumer that relies upon Competitive Supplier’s unique knowledge of, or access to, Participating Consumers gained as a result of this ESA. For the purposes of this provision, “direct marketing” shall include any telephone call, mailing, electronic mail, or other contact between the Competitive Supplier and the Consumer. Broad-based programs of the Competitive Supplier that do not rely on unique knowledge or access gained through this ESA will not constitute such “direct marketing.”

  • Obtaining Stock Exchange Listings The Company will from time to time take all commercially reasonable actions which may be necessary so that the Warrant Shares, immediately upon their issuance upon the exercise of Warrants, will be listed on the principal securities exchanges and markets within the United States of America, if any, on which other shares of Common Stock are then listed.
