Common use of Materials on Private Property Clause in Contracts

Materials on Private Property. The Contractor hereby agrees that no excavated material or materials of construction will be placed by it or for it upon private or non-city owned public property unless an affidavit granting such permission has been obtained from the owners or lessees of said private or non- city owned public property and filed with the Commissioner. In the event that materials are placed on private or non-city owned public property without permission, and such materials are not removed by the Contractor within forty-eight (48) hours after the receipt by it of a written notice from the Commissioner to do so, it agrees that the Commissioner may dispose of such materials, and may deduct the expense thereof from the money due or to become due under this Contract.
