Common use of MCLEODUSA NETWORK Clause in Contracts

MCLEODUSA NETWORK. If McLeodUSA desires at any time to abandon any part of the McLeodUSA Network on which Alliant Energy utilizes Capacity, such that Alliant Energy’s Communications Network would be interrupted, McLeodUSA shall give Alliant Energy sixty (60) days advance notice in writing. Within such sixty (60) day period, Alliant Energy may elect to purchase such McLeodUSA Network assets. If Alliant Energy elects to purchase such abandoned assets, Alliant Energy shall pay McLeodUSA a sum equal to the fair market value of the purchased assets, offset by any amount paid to McLeodUSA by Alliant Energy for the construction of same.
