Membership Qualifications. Registered students at the University of California at Berkeley and other students who meet the criteria established by the BSC Board of Directors qualify for current membership in the BSC. In order to remain eligible for current membership in the BSC, a person must either remain a registered student at the University of California at Berkeley or submit the required forms and secure the approval of the Housing Staff and/or Administrative Committee in advance of each semester of residency. Should a Member become ineligible, they shall quit the premises immediately upon the conclusion of the last semester of eligibility. However, it shall be the responsibility of the Member to properly cancel this agreement in anticipation of that quitting. In unusual circumstances, applicants may be required to demonstrate to the satisfaction of the Administrative Committee their ability to perform the terms and conditions of this contract. BSC reserves the right to deny membership or renewal of membership to any person. This agreement, inter alia, creates a tenancy within California Civil Code Section 1940(a).

Membership Qualifications. (a) The Board shall have authority to adopt rules and regulations applicable to Exchange Members, applicants seeking to become Exchange Members, and persons associated with applicants or Exchange Members, establishing specified and appropriate standards with respect to the training, experience, competence, financial responsibility, operational capability, and such other qualifications as the Board finds necessary or desirable. (b) The Board may from time to time make such changes in such rules, regulations, and standards as it deems necessary or appropriate. (c) Uniform standards for regulatory and other access issues, such as admission to membership and conditions to becoming an Exchange market maker, shall be promulgated and applied on a consistent basis, and the Company shall institute safeguards to ensure fair and evenhanded access to all of its services and facilities.
Membership Qualifications. The termQualified Entity” means (i) the Manager, (ii) Congregations, (iii) other entities qualified as nonprofit organizations under Section 501(c)(3) of the Code or any successor provision thereto that are affiliated or associated with the Manager and/or one or more Congregations (“UU Affiliated or Associated Charitable Organizations”) and (iv) entities that provide or are intended in the future to provide financial support for one or more of the Manager, a Congregation or a UU Affiliated or Associated Charitable Organization, provided that each Qualified Entity must fall into one of the categories set forth in Section 3(c)(10)(B) of the Investment Company Act of 1940 or any successor provision thereto. The Manager must have been organized and be operated exclusively as a Qualified Entity. The Manager shall be a Member without augmentation or diminution of its rights, obligations and status as Manager or as a Member through ownership of Units or of the rights, obligations and status of the other Members. Each Member of the Fund shall, at the time of admission and at all times during its Membership, be a Qualified Entity and must at all times be able to demonstrate to the Manager’s satisfaction that it was and is a Qualified Entity. Other than in the case of the Manager (but solely in its capacity as Manager), the status of Member shall be conferred upon acquisition of ownership of Units and shall cease if no Units are owned. While a Member of the Fund, each Member shall comply with applicable laws permitting such Member to hold Membership Interests.

In unusual circumstances, applicants may be required to demonstrate to the satisfaction of the Administrative Committee their ability to perform the terms and conditions of this contract. Membership Qualifications. The Program is open to dental practices (excluding institutions, community health centers, government organizations, cost reporting entities and large Dental Service Organizations (as designated by Xxxxx Xxxxxx)) who: (a) operate a licensed practice in the United States and (b) have agreed to these Program Terms by entering the Member’s required information; (each an “Eligible Practice” or “Member”). Eligibility for the Program is at Xxxxx Xxxxxx’x sole discretion. The Program is void where prohibited. The Program is limited to one Member account per Eligible Practice. Xxxxx Xxxxxx may refuse to create an account for any reason.

In the event that Participant becomes aware that the security of its Member ID has been comprised or breached, Participant must notify Rain Bird and secure a new Member ID. Any individual who changes a Participant’s contact information represents and warrants to Rain Bird that he or she is duly authorized on behalf of the Participant to make such changes.
