Minimum Breaks. 6.5.1 A break of at least nine (9) continuous hours must be provided wherever possible between any two qualifying periods of work. Except that if a ten (10) hour duty has been worked then a break of twelve (12) consecutive hours must be provided wherever possible.
6.5.2 The qualifying periods of work for the purposes of this clause are:
a) Periods of normal rostered work; or
b) Periods of overtime that are continuous with a period of normal rostered work; or
c) Full shifts of overtime/ call back duty.
6.5.3 This requirement to provide a break wherever possible applies whether or not any additional payment will apply under the provisions of this clause.
6.5.4 If a break of at least nine (or twelve) continuous hours cannot be provided between periods of qualifying duty, the duty is to be regarded as continuous until a break of at least nine (or twelve) continuous hours is taken and it shall be paid at overtime rates, with proper regard to the time at which it occurs and the amount of overtime that precedes it.
6.5.5 The additional payment provisions of this clause will not apply in any case where the result would be to give an employee a lesser payment that would otherwise have been received.
6.5.6 Time spent off duty during ordinary hours solely to obtain a nine (or twelve) hour break shall be paid at ordinary time rates. Any absence after the ninth (or twelfth) continuous hour of such a break, if it occurs in ordinary time, shall be treated as a normal absence from duty.
6.5.7 If a call back of less than a full shift is worked between two periods of duty of a full shift or more a break of nine continuous hours must be provided either before or after the call back. If such a break has been provided before the call back it does not have to be provided afterwards as well. Except that if time is spent working as a result of a call-back between the hours of 2300 and 0500 hours, a nine (or twelve) hour break after the call back is completed must be provided.
Minimum Breaks. 5.1 A break of at least nine (9) continuous hours will be provided wherever possible between any two qualifying periods of work.
5.2 The qualifying periods of work for the purposes of this clause are: • A duty, including any overtime worked either as an extension or as a separate duty; or • call-back where the daily ordinary hours or more are worked continuously.
5.3 If a call-back of less than a continuous nine hour period is worked between two other qualifying periods of work, a break of nine continuous hours must be provided either before or after the call-back. If such a break has been provided before the call-back it does not have to be provided afterwards as well.
5.4 If a break of at least nine continuous hours cannot be provided between qualifying periods of work, the period of work is to be regarded as continuous until a break of at least nine continuous hours is taken and it shall be paid at the overtime rate.
5.5 Time spent off duty during ordinary hours of work solely to obtain a nine-hour break shall be paid at the normal hourly rate of pay. Any absence after the ninth continuous hour of such a break, if it occurs during ordinary hours of work, shall be treated as a normal absence from duty.
Minimum Breaks. (a) A break of at least 9 continuous hours must be provided wherever possible between any 2 qualifying periods of work. Except that if a 10-hour duty has been worked then a break of 12 continuous hours must be provided wherever possible.
Minimum Breaks a) A break of at least nine (9) continuous hours must be provided wherever possible between any two qualifying periods of work. Qualifying periods of work for the purposes of this clause are:
i. A duty, including any overtime worked either as an extension or as a separate duty; or
ii. Call-back where eight (8) hours or more are worked continuously.
b) Except that if a ten (10) hour duty has been worked then a break of twelve (12) consecutive hours must be provided wherever possible.
c) If a call-back of less than a continuous eight (8) hour period is worked between two other qualifying periods of work, a break of nine (9) continuous hours must be provided either before or after the call-back. If such a break has been provided before the call-back it does not have to be provided afterwards as well.
d) Except, for those employees who are called back between 2300 and 0500 hours, the roster should facilitate a 9 hour break wherever possible.
e) If a break of at least nine (9) continuous hours –or twelve (12) – cannot be provided between qualifying periods of work, the period of work is to be regarded as continuous until a break of at least nine (9) or twelve (12) continuous hours is taken and it shall be paid at the overtime rate.
f) Time spent off duty during ordinary hours of work solely to obtain a nine (9) – or twelve (12) – hour break shall be paid at the normal hourly rate of pay. Any absence after the ninth – or twelfth – continuous hour of such a break, if it occurs during ordinary hours of work, shall be treated as a normal absence from duty.
Minimum Breaks. 6.1 Except when required for urgent or emergency work and except as provided in 6.2 no employee shall be required to work for more than five hours continuously without being allowed a meal break of not less than half an hour.
6.2 An employee unable to be relieved from work for a meal break shall be allowed to have a meal on duty and this period shall be regarded as working time.
6.3 Except where provided for in 6.2 an employee unable to take a meal after five hours' duty shall be paid at overtime rates from the expiry of five hours until the time when a meal can be taken.
6.4 Rest breaks of 10 minutes each for morning tea, afternoon tea or supper, where these occur during duty, shall be allowed as time worked.
6.5 Where an employee is required to change from their protective or work clothing prior to leaving the employer’s premises, sufficient time will be allowed on duty at the end of each work day or shift to change clothing.

c) Employees may agree to have less than a nine (9) hour break. Where the employees so agree this shall be recorded in writing.
d) Time spent off duty during normal hours solely to obtain a nine (9) hour break shall be paid at normal time rates.

7.2 If a break of at least nine continuous hours cannot be provided between the two periods of duty, the period of work is to be regarded as continuous until a break of at least nine continuous hours is taken and it shall be paid at the overtime rate.
7.3 Time spent off duty during ordinary hours of work solely to obtain a nine hour break shall be paid at the ordinary hour rate paid. Any absence after the 9th continuous hour of such a break if it occurs during the ordinary hours of work, shall be treated as a normal absence from duty.
Minimum Breaks. (a) A break of at least nine (9) continuous hours must be provided wherever possible between any two qualifying periods of work of a full duty or more, except that if a 10-hour duty has been worked then a break of 12 consecutive hours must be provided wherever possible.
(b) The qualifying periods of work for the purposes of this clause are:
(i) A duty, including any overtime worked either as an extension or as a separate duty; or
(ii) (ii) Call back where the daily ordinary hours or more are worked continuously.
(c) If a break in accordance with clause 2.8(a) cannot be provided between qualifying periods of work, the period of work is to be regarded as continuous until a break of at least nine or 12 continuous hours is taken and it shall be paid at the overtime rate as specified in clause 2.11.(a) below.
(d) Time spent off duty during ordinary hours of work solely to obtain a nine-hour (or 12 hour) break shall be paid at the normal hourly rate of pay. Any absence after the ninth or twelfth continuous hour of such a break, if it occurs during ordinary hours of work, shall be treated as a normal absence from duty.
Minimum Breaks. 12.4.1 If a call-back of less than a continuous eight (8) hour period is worked between two other qualifying periods of work. In that case, a break of nine (9) continuous hours must be provided either before or after the call-back. However, if such a break has been provided before the call- back, it does not have to be provided afterwards as well.
12.4.2 Except, for those employees who are called back between 2300 and 0500 hours, the break must be provided afterwards, unless otherwise agreed between the employer and the employee.
Minimum Breaks. 17.1 A Team Member will be provided with a minimum break of 10 hours between the completion of work on 1 day and the commencement of work on the next day. A lesser break can apply if a Team Member has worked less than 6 hours continuously, excluding meal breaks, provided that mutual agreement has been reached between the Company and the Team Member.
