Common use of Minimum Throughput Capacity Clause in Contracts

Minimum Throughput Capacity. TLO represents to TRMC that as of the Commencement Date, the average throughput capacity of each Segment is set forth on Schedule B (the “Minimum Throughput Capacity”). TLO agrees to reserve the entire throughput capacity of each Segment (including any increase in the throughput capacity of any Segment in connection with a Capacity Expansion) for throughput by TRMC. TLO shall maintain the average throughput capacity of each Segment at no less than the Minimum Throughput Capacity.

TLO shall maintain the average throughput capacity of each Segment the Segments at no less than the Minimum Throughput Capacity.
