Misconduct/Unsatisfactory Performance. (a) After carrying out an investigation as described in subclause (a) the Mission considers that the employee's actions constitute misconduct or the employee's performance is unsatisfactory, the Mission shall follow the procedure set out below:
(b) On the occasion of the first warning the employee shall be advised of: ▪ the aspect of the behaviour or performance which is unsatisfactory ▪ the consequences of continuing unsatisfactory behaviour or performance (on- going employment will be in jeopardy) ▪ the actions to take to correct the problem, if applicable ▪ the period allowed for an improvement ▪ the first warning should also include any commitment that the employee is prepared to give to improve his/her conduct. A sample format is shown in the guidelines. ▪ The details of the first warning shall be confirmed in writing.
(c) The Mission may determine that the employee’s actions are such as to warrant the giving of a second warning in the first instance.
Misconduct/Unsatisfactory Performance. 3.8.2.1 In the case of unsatisfactory performance or misbehaviour not immediately amounting to serious and wilful misconduct, the following process applies:
1. The Employee’s supervisor/manager will establish the facts;
2. At any stage an Employee may request the presence of a representative or support person of their choice to attend in person or by telephone;
3. Nothing in this procedure will prevent SA Water from bypassing one or more stages where the conduct is serious and warrants such a measure, but does not justify immediate dismissal.
