Misspent Funds. The VENDOR will refund expenditures of the VENDOR that are contrary to this AGREEMENT and deemed inappropriate by the DEPARTMENT or designee.

Misspent Funds. The GRANTEE must fully reimburse the COUNTY for any award amount that was misspent by either the GRANTEE. The COUNTY may offset future funding to the relevant GRANTEE in order to make any reimbursement owed under this subsection.

If Recipient Abandons Activity Subject to clause 19.4(b), if the Recipient has: Abandoned the Activity; notified ARENA of an intention to Abandon the Activity; or stated an intention to Abandon the Activity, and does not, when requested by ARENA, demonstrate to ARENA's satisfaction within 14 days that the Recipient will proceed with the Activity, ARENA is entitled to recover from the Recipient an amount equal to the total value of the Funds. ARENA is not entitled to recover under clause 19.4(a) if the Recipient satisfies ARENA that it acted on reasonable technical grounds in deciding to Abandon the Activity. Government funding On expiry or termination of this Agreement, if the Recipient has received any contribution to the Activity from the Commonwealth or a State, Territory or local government other than the Funds or contributions specified in item 5 of Schedule 4, ARENA is entitled to recover from the Recipient the lesser of the Funds and the amount of the contribution. Repayment notice ARENA may give the Recipient a notice requiring the Recipient to pay to ARENA (or deal with as specified by ARENA) an amount which ARENA is entitled to recover under this clause 19 or clause 23. If ARENA gives a notice under clause 19.6(a), the Recipient must pay the amount specified in the notice in full (or deal with it as specified by ARENA) within 30 days after the date of the notice.
