Common use of Misuse of Goods Clause in Contracts

Misuse of Goods. Heraeus disclaims liability that may arise: if the Customer or any third party modifies, misuses, improperly installs or repairs the Goods; if the Goods suffer an accident, neglect, or adverse conditions; or if the Goods are used contrary to published specifications or instructions of use. The warranty under Section 3.1 will terminate when Customer incorporates the Goods into Customer’s products, even if the warranty has not expired, unless the Goods were verified to comply specifications using tests or methods acceptable to Heraeus.

Misuse of Goods. The warranty under Section 3.1 will terminate when Customer incorporates the Goods incorporated as a component into Customer’s products, even if the warranty has not expired, unless the Goods were verified to comply specifications using tests or methods acceptable to Heraeusa device.
